Description
The Department of Health and Human Services, National Institutes of Health, Clinical Center, intends to negotiate for commercial supplies and services on a sole source basis, in accordance with the format in Federal Acquisition Regulations (FAR) Subpart 12.6, as supplemented with additional information included in this notice. The Government intends to negotiate on a sole source basis with Siemens Medical Solutions, Molecular Imaging, 810 Innovation Drive, Knoxville, TN 37932. The Government intends to negotiate a one-year base contract with four one-year options to extend the period of performance. The Government will obtain maintenance and support for one Siemens High Resolution Research Tomograph (HRRT) System, Part Number 320206, Serial Number 401001. The supplies and services are proprietary and commercial as defined in FAR Part 2. The Siemens HRRT system is currently located on the National Institutes of Health?s main campus in Bethesda, Maryland. The Contractor shall provide preventive maintenance, emergency visits, spare parts, and hardware and software upgrades to the Siemens High Resolution Research Tomograph (HRRT) System. The total amount of the contract, including all option periods shall not exceed $5 million. Siemens Medical Solutions, Molecular Imaging is the only known source capable of providing the proprietary hardware and software upgrades required to maintain the Siemens High Resolution Research Tomograph (HRRT) System as well as provide the spare parts and maintenance support. This action is under the authority of 41 U.S.C. 253( c )(1), as set forth in FAR 6.302-1 and HHSAR 306-302-1. Only one responsible source and no other supplies or services will satisfy agency requirements. This acquisition shall be processed using Simplified Acquisition Procedures for commercial items prepared in accordance with the format in FAR Subpart 12.6 as supplemented with additional information included with this notice. This is not a Small Business Set-Aside. The North American Industry Classification System (NAICS) Code for this procurement is 811219, Other Electronic and Precision Equipment Repair and Maintenance. The Small Business Size Standard is $6.0 million. An award will be made based upon the best overall value to the Government. All Business Concerns must be registered in the Central Contractors Registration Database (http:www.ccr.gov) in accordance with FAR Clause 52.204-7: Central Contractor Registration. The following provisions/clauses are applicable to this solicitation: FAR 52.212-1, Instructions to Offerors-Commercial Items; FAR 52.212-2, Evaluation-Commercial Items; FAR 52.212-3, Offeror Representations and Certifications-Commercial Items; FAR 52.212-4, Contract Terms and Conditions-Commercial Items; FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items; FAR 52.232-33, Payment by Electronic Funds Transfer-Central Registration; FAR 52.246-2, Inspection of Supplies-Fixed Price; FAR 52.246-4, Inspection of Services-Fixed Price; and FAR 52.217-9, Option to Extend the Term of the Contract. Full text of these clauses may be found at http://www.acqnet.gov. Maintenance services required under this contract shall be performed at the National Institutes of Health, Bethesda, Maryland 20892. Interested parties may identify their interest and capability to respond to this requirement or submit proposals. This notice of intent is not a request for competitive proposals. However, all proposals received within 45 calendar days after publication of this synopsis will be considered by the Government. The 45 day response time is established in accordance with FAR 5.203 and considered reasonable for this acquisition. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. (See Numbered Note 22)
