N/A 17. This is a Department of the Army notice of proposed contract action. The Government intends to award a purchase order using FAR Part 13 procedures to Freestate Electrical Service Company, Beltsville, MD for the installation of conduit raceways within the building located at 4501 Ford Avenue, Alexandria, VA 22302. Consistent with the requirement at FAR 5.207(c)(14), the Government justifies the lack of competition for the following reason: The lessor of the building, pursuant to the terms of lease # GS -11B-01849, has the exclusive right to determine what vendor, if any, shall be permitted to install equipment in that building. Any inquiries must be received no later than 11:30 AM Central Time, September 30, 2006. The proposed order constitutes the acqu isition of a commercial item, as that term is defined in FAR 2.101 and referenced in FAR 5.203(a)(1) and FAR 5.203(c). See government-wide numbered note 22. Within that note 45 days is changed to read 2 days. Although the proposed contractual action has been synopsized through the Government-wide Point of Entry (GPE) by way of this notice, the solicitation will not be made available through the GPE. The Government will not make the solicitation available through the GPE because, in accordance with t he exception at FAR 5.102(a)(4)(ii), the nature of the file does not make it practicable for the Contracting Officer to provide access through the GPE.
