- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The request for quotation (RFQ) number is HSCG88-06-Q623348. The synopsis/solicitation constitutes a request for quotation (RFQ) and incorporates provisions and clauses in effect through Federal Acquisition Circular 2005-11. This is Total Small Business Set Aside procurement to provide repair and maintenance of 8.5 ton capacity material handling mobile crane. The NAICS code is 811310 with a small business size standard of $6.5 Million. The government intends to award a Firm Fixed Price Order/Contract utilizing Simplified Acquisition Procedures (SAP). IMPORTANT NOTICE: The provision at 52.212-2 Evaluation ? Commercial Items (Jan 1999) applies to this acquisition. In accordance with FAR Clause 52.232-33, PAYMENT BY ELECTRONIC FUNDS TRANSFER ? CENTRAL CONTRACTOR REGISTRATION (OCT 2003), as contained in the solicitation Contract Clauses, the Government shall make payment to the Contractor using the EFT information contained in the Central Contractor Registration (CCR) database. In the event that the EFT information changes, the Contractor shall be responsible for providing the updated information to the CCR database. The Government may make payment by EFT through either the Automated Clearing House (ACH) network, subject to the rules of the National Automated Clearing House Association, or the Fedwire Transfer System. The rules governing Federal payments through the ACH are contained in 31 CFR part 210. GENERAL. 1.01. OBJECTIVE: Provide services to accomplish repairs, maintenance, load test, and make fully operational one Grove Model AP308 8.5-ton capacity material handling mobile crane at USCG Group Portland, Portland, Oregon, in accordance with the listed items of work in this Scope of Work document. 1.02 LIAISON: The primary technical Point Of Contact (POC) at Group Portland is Group Engineer Senior Chief Petty Officer David Sparkenbaugh at (503)240-9364. POC at Coast Guard CEU Oakland is Jay Lindborg at (510)535-7226. 1.03. LOCATION: All work for the repair and maintenance of the mobile crane shall be performed at the Contractor?s repair and maintenance facility. 1.04. SITE VISIT: Access to the site will be available during normal working hours. Contact the technical POC a minimum of one week in advance to arrange initial site access and coordinate entrance into the facility. 1.05.CONTINUITY OF STATION OPERATION: Perform all on-site visitation between the hours of 8:00 AM and 4:30 PM, Monday through Friday (Federal Holidays excluded), unless otherwise approved by the Contracting Officer. 1.06. NOTIFICATION OF START AND COMPLETION OF WORK: The Contractor shall notify the Contracting Officer in writing five (5) working days in advance of the date he intends to commence work, and five (5) working days prior to the date the crane will be ready for delivery to the Coast Guard Group Portland facility. 1.07. RECYCLING AND DISPOSAL OF REFUSE: Refuse, excess or waste materials resulting from construction or repair operations shall become the property of the Contractor and shall be recycled and/or disposed of off Government property. All disposal shall be done in accordance with Federal, State, and local regulations. 1.08. SAFETY: During execution of this contract, the Contractor shall conform to the rules and regulations as set forth by OSHA Safety and Health Standards, 29 CFR Part 1926 - Safety and Health Regulations for Construction. When the standards differ, the more restrictive standard shall apply. 2.00. SCOPE. 2.01. BACKGROUND: Grove AP308 mobile crane manufacturer: Grove Manufacturing Company, Box 21, Shady Grove, Pennsylvania 17256, Tel: (717)597-8121, Fax: (717)597-4062. NOTE: Existing Grove model AP308 mobile crane was delivered new to Coast Guard Group Portland in 1988. 2.02. MOBILE CRANE DESIGN: The mobile crane is a self-propelled, 2x4 wheel drive, 8.5-ton capacity, (7-1/2-ton capacity pick and carry), diesel powered, three section hydraulic boom, enclosed cab, with full hydraulic outriggers at all four corners. 2.03.SCOPE OF WORK: Repair and maintenance of one Grove Model AP308 mobile crane, as listed below: NOTES: Contractor shall provide to Coast Guard CEU Oakland Contracting Officer (Amelia (Nelly) San Nicolas, tell: 510-535-7219) a written cost estimate for Grove crane work items indicated in this Scope of Work document. Email of the cost estimate to the Contracting Officer at (anelia.j.sannicolas@uscg.mil) is acceptable. Contractor shall provide a fully operational rental mobile crane of equivalent design, self-propelled, diesel powered. 8-1/2-ton capacity, minimum. The crane shall be delivered, off-loaded, and made ready for immediate use at the Coast Guard Group Portland facility when the existing Coast Guard Grove crane is picked up for transport to the Contractor?s facility. Contractor shall provide crane operating and safety instructions to Coast Guard Group Portland personnel. The words ?replace, repair, or install? shall mean installation of new factory, Grove Manufacturing Company, or equal, approved parts or materials for the following listed work items: A. Install PAT (PAT is an acronym for the German company that manufactures the on-board LMI computer system) vent for weatherproofing Load Moment Indicator (LMI) electrical box central ventilation kit. Replace cover gasket with new. B. Disassemble hoist and inspect per Grove service bulletin #00-014. Reassemble using new seals, bearings, and wear items as needed. C. Disassemble swing drive, and locate cause of leak. Reassemble with new parts as needed. D. Install guard over hydraulic and fuel tanks. E. Repair cracks on cab side of crane, and reinforce per manufacturer?s specifications. F. Reseal lift cylinder, and replace bushings. G. Disassemble boom, install new seals in telescope cylinder, install new wear pads, retract cable, and bushing for retract sheave. H. Repair cab insulation. I. Install ?-inch mar-resistant Lean polycarbonate skylight. J. Replace left rear tire, tire tube (if required), and valve stem(s) with new. K. Replace anti-two block switch at boom tip. L. Replace anti-two block cable. M. Install decal on shift lever. N. Repack wheel bearings, replace brake shoes, wheel cylinders, and master cylinder, flex brake lines, bleed and adjust brakes. O. Replace fluids in differentials, transmission, and radiator, including engine oil and filter. P. Replace all air and fluid filters. Q. Replace all radiator hoses. R. Engine: Adjust valves; replace valve cover gasket(s). Test injectors (replace if needed). S. Replace serpentine belt with new, and replace hydraulic pump drive if needed. T. Perform operational load test, and provide written certification to the Contracting Officer within 10 calendar days of load test completion. U. During the course of repair and maintenance work, if additional work items are discovered contact the Contracting Officer immediately. Contractor shall advise whether the additional work item(s) are required. Contractor shall not proceed with any additional work items without the approval of the Contracting Officer. 2.04 CRANE SAFETY INSPECTION: Additionally, perform a safety inspection of the crane. Indicate whether items are present/missing, serviceable/not-serviceable, or other safety related items. Notify the Contracting Officer in accordance with paragraph 2.03 U. Pick up of existing Grove AP308 mobile crane at Coast Guard Group Portland, and delivery of rental crane shall be coordinated by contacting Senior Chief David Sparkenbaugh at (503)240-9364, five (5) working days in advance of pick up and delivery. Hours to contact Senior Chief Sparkenbaugh are 8AM to 3PM, Monday through Friday. B. The pick up and delivery area is paved asphaltic concrete. 3.01. SUBMITTALS. A. Operational Load Test Report: Written results of the load test shall be submitted to the Contracting Officer within 10 calendar days of load test completion. 4.00. EXECUTION. 4.01. GENERAL: Inspect, remove, replace, manufacture or purchase repair components as necessary to affect repairs to the mobile crane, and make fully operational. 4.02. OPERATIONAL LOAD TEST: Load test shall be performed at the Contractor?s facility. Additionally, perform overload test of crane to test operational condition of the Load Moment Indicator (LMI) system. Written results of the load test shall be submitted to the Contracting Officer within 10 calendar days of load test completion. END OF SECTION. Upon request, the Contracting Officer will make available the ?Grove Hoist Maintenance and Inspection Service Bulletin?. The provision FAR 52.212-1, Instructions to Offerors ? Commercial Items (Jan 2006) applies (with f). Offerors must include a completed copy of the provision at FAR 52.212-3, Commercial Items (June 2006), with its offer. The clause at FAR 52.212-4, Contract Terms and Conditions- Commercial Items (Sept 2005) ADDENDUM to FAR 52.212-4, HSAR 3052.209-70 PROHIBITION ON CONTRACTS WITH CORPORATE EXPATRIATES (JUN 2006) (a) Prohibitions. Section 835 of Public Law 107-296, prohibits the Department of Homeland Security from entering into any contract with a foreign incorporated entity after November 25, 2002, which is treated as an inverted domestic corporation as defined in this clause. The Secretary shall waive the prohibition with respect to any specific contract if the Secretary determines that the waiver is required in the interest of homeland security, or to prevent the loss of any jobs in the United States or prevent the Government from incurring any additional costs that otherwise would not occur. (b) Definitions. As used in this clause: Expanded Affiliated Group means an affiliated group as defined in section 1504(a) of the Internal Revenue Code of 1986 (without regard to section 1504(b) of such Code), except that section 1504 of such Code shall be applied by substituting `more than 50 percent' for `at least 80 percent' each place it appears. Foreign Incorporated Entity means any entity which is, or but for subsection (b) of section 835 of the Homeland Security Act, Public Law 107-296, would be, treated as a foreign corporation for purposes of the Internal Revenue Code of 1986. Inverted Domestic Corporation. A foreign incorporated entity shall be treated as an inverted domestic corporation if, pursuant to a plan (or a series of related transactions)? (1) The entity completes after November 25, 2002, the direct or indirect acquisition of substantially all of the properties held directly or indirectly by a domestic corporation or substantially all of the properties constituting a trade or business of a domestic partnership; (2) After the acquisition at least 80 percent of the stock (by vote or value) of the entity is held-(i) In the case of an acquisition with respect to a domestic corporation, by former shareholders of the domestic corporation by reason of holding stock in the domestic corporation; or (ii) In the case of an acquisition with respect to a domestic partnership, by former partners of the domestic partnership by reason of holding a capital or profits interest in the domestic partnership; and (3) The expanded affiliated group, which after the acquisition includes the entity, does not have substantial business activities in the foreign country in which or under the law of which the entity is created or organized when compared to the total business activities of such expanded affiliated group. Person, domestic, and foreign have the meanings given such terms by paragraphs (1), (4), and (5) of section 7701(a) of the Internal Revenue Code of 1986, respectively. (c) Special rules. The following definitions and special rules shall apply when determining whether a foreign incorporated entity should be treated as an inverted domestic corporation. (1) Certain stock disregarded. For the purpose of treating a foreign incorporated entity as an inverted domestic corporation these shall not be taken into account in determining ownership: (i) stock held by members of the expanded affiliated group which includes the foreign incorporated entity; or (ii) stock of such entity which is sold in a public offering related to the acquisition described in subsection (b)(1) of Section 835 of the Homeland Security Act, Public Law 107-296. (2) Plan deemed in certain cases. If a foreign incorporated entity acquires directly or indirectly substantially all of the properties of a domestic corporation or partnership during the 4-year period beginning on the date which is after the date of enactment of this Act and which is 2 years before the ownership requirements of subsection (b)(2) are met, such actions shall be treated as pursuant to a plan. (3) Certain transfers disregarded. The transfer of properties or liabilities (including by contribution or distribution) shall be disregarded if such transfers are part of a plan a principal purpose of which is to avoid the purposes of this section. (d) Special rule for related partnerships. For purposes of applying section 835(b) of Public Law 107-296 to the acquisition of a domestic partnership, except as provided in regulations, all domestic partnerships which are under common control (within the meaning of section 482 of the Internal Revenue Code of 1986) shall be treated as a partnership. (e) Treatment of Certain Rights. (1) Certain rights shall be treated as stocks to the extent necessary to reflect the present value of all equitable interests incident to the transaction, as follows: (i) Warrants; (ii) Options; (iii) Contracts to acquire stock; (iv) Convertible debt instruments; (v) Others similar interests. (2) Rights labeled, as stocks shall not be treated as stocks whenever it is deemed appropriate to do so to reflect the present value of the transaction or to disregard transactions whose recognition would defeat the purpose of section 835. (f) Disclosure. By signing and submitting its offer, an offeror under this solicitation represents that it not a foreign incorporated entity that should be treated as an inverted domestic corporation pursuant to the criteria of Section 835 of the Homeland Security Act, Public Law 107-296 of November 25, 2002. (g) If a waiver has been granted, a copy of the approved waiver shall be attached to the bid or proposal. (End of provision) applies to this acquisition.
