Description
The U.S. Army Medical Research Acquisition Activity intends to acquire services at the Armed Forces Institute of Pathology (AFIP) in support of its Graphic Design and Malpractice and Credentials Database Support for the Department of Defense (DOD) Mi ssion of Information Gathering and Analysis for Quality Assurance and Risk Management Purposes. The contract period of performance will be from date of award for a one base period of performance with four one year option periods. This is a combined synops is/solicitation for commercial services prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not issued. This is a Request For Quotes (RFQ and the solicitation documentation and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 9-45. PERFORMANCE WORK STATEMENT DEPARTMENT OF LEGAL MEDICINE SUPPORT STAFF Agency/Activity: Armed Forces Institute of Pathology Washington, D.C. 20906 Title: Graphic Design and Malpractice and Credentials Database Support for the Department of Defense (DoD) Mission of Information Gathering and Analysis for Quality Assurance and Risk Management Purposes Definitions: CCQAS  Centralized Credentials Quality Assurance System maintained by the DoD NPDB  National Practitioner Data Bank SPSS  Statistical Package for the Social Studies IQRS  Integrated Querying and Reporting Service AAR  Adverse Action Report BHPr  Bureau of Health Professions CMS  Centers for Medicare and Medicaid EFT  Electronic Funds Transfer HIPDB  Healthcare Integrity and Protection Data Bank HRSA  Health Resources and Services Administration ICD  Interface Central Document MMER  Medicare/Medicaid Exclusion Report MMPR  Medical Malpractice Payment Report QPRAC  Query on Practitioners AMA Physician Masterfile  A collection of educational and credentialing data on all physicians in the United States QuarkXPress 6.0  A software package enabling risk management data to be incorporated into a graphics package to facilitate desktop publishing Background: The Department of Legal Medicine is mandated by regulation (DoD 6025.13R) to monitor and analyze the data reported to the Centralized Credentials Quality Assurance System, and must submit statistical information and reports on all available administrati ve or completed legal cases that arise from allegations of negligence in DoD MTFs or activities. The Department of Legal Medicine must assist in educational programs, reports, and publications that shall assist Federal health care providers in meeting c ontinuing medical education requirements and shall collaborate with the Federal Agencies and the private sector in order to obtain and develop appropriate civilian medical malpractice data for use by the Department of Defense. In order to accomplish this mission mandated by DoD, the Department produces and distributes its annual risk management journal, Legal Medicine, to every active duty DoD physician, assisting them in meeting their continuing medical education requirements, as required by DoD regulation. In order to achieve its DoD mission of tracking malpractice and other Federal data for comparison with DoD statistics, the Department maintains sharing agreements with several Federal entities, to include the Navy Recruiting Command, the United States Coast Guard, and the United States Department of Justice. Through its critical role as an information clearinghouse, the Department of Legal Medicine tracks and reports on malpractice and quality assurance parameters both withi n and outside DoD, in order that DoD can identify high risk areas and target remedial efforts in military hospitals throughout DoD. Objectives: The Department of Legal Medicine expects timely and ac curate malpractice and credentials data extraction and analysis, along with suggested remedial measures to target high risk areas of health care presented in both a printed and an electronic medium and distributed worldwide to all DoD active duty military and civilian health care providers. Scope: The contractor will engage in an ongoing surveillance of all incoming DoD medical malpractice claims from all three military services and provide monthly reports on specified parameters utilizing required software (i.e., IQRS, QPRAC and SPSS). The contrac tor will further research and validate all required incoming credentials packages, again utilizing required software, and will complete review of all incoming work within a 30 day period. Finally, the contractor will analyze all incoming DoD and other fed eral malpractice and quality assurance data in such a way as to identify high risk areas and produce meaningful remedial continuing medical education programs. Specific Tasks: 1. Case Accessioning  The Contractor will furnish personnel proficient in required software to accession all available open and closed DoD medical malpractice claims, which will then be reviewed for the extraction of specified data, such as date filed, ty pe of allegation, amount claimed, facility and provider involved, etc. 2. Monthly Report  A monthly report will be compiled showing all malpractice claims received and containing specific information on type of claim, amount claimed, location of facility, identity of provider, etc. 3. Analysis  The contractor will statistically analyze all monthly data, utilizing SPSS and other required software, and identify and report on any repetitive allegations, increased frequency of medical misadventures at specific facilities, or suspicious practice patterns regarding individual practitioners. 4. Credentials Review  The contractor will research and validate by use of QPRAC, IQRS, and HIPDB, all required educational and training background information on all military and other federal civilian health care providers to include, but not be limited to, the following information: a. Education, to include college specific to licensure and medical school. b. Internship, residency and fellowship training. c. State licensure information d. Board certification status, as defined by the American Board of Medical Specialties; and other board certifications based on scope of practice (e.g., National Commission on Certification of Physician Assistants [NCCPA]; American Association of Nurse Pra ctitioners [AANP]; and National Registry of Emergency Medical Technicians [NREMT]). e. Possession of certificates issued by the National Board of Medical Examiners (NBME) or the United States Medical Licensing Examination (USMLE); Fifth Pathway or Education Commission of Foreign Medical Graduates (ECFMG). f. The existence of criminal convictions, especially those involving crimes of moral turpitude. g. The existence of prior paid medical malpractice claims, utilizing all available sources, to include CCQAS, NPDB, as well as all three military service databases. All aspects of the credentials review must be completed within 30 days of the request. 5. Continuing Medical Education  To fulfill the DoD mandated mission of provision of continuing medical education to all active duty and civilian military health care providers, the contractor will assemble and analyze meaningful data on medical misadvent ures, will highlight high risk areas, and will fashion remedial measures in order to reduce patient morbidity and mortality, as well as reduce monetary losses through malpractice pay-outs. This data will be converted into journal format through an advance d software process, i.e., QuarkXPress 6.0. The contractor will then produce the journal, entitled Legal Medicine, once per year and will distribute it in both written and electronic versions to every active duty military and civilian health care provide r in DoD. This includes complex editing of articles submitted, as well as in depth work with editor and other program designers to accomplish the task on schedule and without errors. When the journal is published, the contractor is then responsible to make su re that all CMEs submitted to the Department of Legal Medicine by the various DoD physician providers. This will provide every participating DoD physician evidence of the completion of their risk management educational requirements. 6. The criteria for acceptance of deliverables is as follows: " All cases will be accurately accessioned with less than one error per 100 cases. " Monthly reports will be produced in a timely fashion on the first of each month. " Individual providers credential reviews will be completed within 30 days of receipt. " The Legal Medicine Journal will be produced once per year " Evidence of educational participation will be furnished to health care providers within 14 days of receipt of their completed educational quiz forms. Contract Type  Firm Fixed Price. Place of Performance: 1335 East West Highway Suite 6-100 Silver Spring, MD 20910 Delivery Schedule: " Monthly Accessions Reports will be completed on the first of each month. " Credential Reviews will be completed within 30 days of case receipt. " Legal Medicine Journal will be produced annually. " Educational Participation Certificates will be provided to participants within 14 days of course completion. Contract Deliverables: " The monthly accessions report should address the type of claim, amount of claim, location of facility, and identity of provider in memorandum format. Criteria for acceptance of the report shall be timeliness, accuracy, meaningful analysis, and utility i n designing remedial program to target high risk areas of medicine. The report should be submitted to Dr. Frank T. Flannery, Chairman, Department of Legal Medicine. " Identification of Contractor Personnel  All such personnel must clearly identify themselves as contractor personnel by identification badges, correspondence, and emails. " Government Furnished Support  Contractor personnel will be furnished with computers, telephones, duplication devices, and software necessary to perform the mission (i.e., QuarkXPress 6.0, CCQAS, QPRAC and SPSS). Security: All contractor personnel must possess an NAC Security clearance. They will have full access to government computers, and they may be asked to attend educational offerings in order to update their skills. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP) The Department of Legal Medicine will be tasked with assuring that the quality assurance of the contractor services for the Federal government. All inspections of performance work products will occur on site at the Department of Legal Medicine at frequen t intervals. The QASP will measure the performance of the contractor against the standards that were outlined for each task in the PWS. The QASP for each task will be outlined in this section. However, as the government personnel and contractor personne l work side-by-side at the Department of Legal Medicine, there essentially will be continuous quality assurance activities. Case Accessioning: A weekly review of the data entered for medical malpractice case accessioning including review of the date filed, the allegation type, the amount claimed and the amount paid, etc. will be performed. The method of surveillance for this t ask will be 100% inspection during the first three months followed by random sampling of records thereafter on a monthly basis. Additionally, customer input through query of the three military services and DoD Health Affairs regarding any subsequent data produced from this data base will be evaluated as well on a periodic basis. The Monthly Report: There will be a 100% review of every monthly report including timeliness and accuracy of the report. Analysis of the Data: Month ly review of the validity of the statistical analysis in each monthly report will be performed on 100% of the data produced in each monthly report. Credentials Review: There will be a weekly review of the accuracy and timeliness (within 30 days) of all provider credential files, including demographic information, educational information, residency training, fellowship training, licenses, certificates and board examinations. A 100% review will occur during the first 4 months. After this period a random review will be substituted on a monthly basis for accuracy and timeliness. Customer input will also be used as an important element of the method of surveillance for this task. On a monthly basis contact will be made with the customers who receive the credentials files in order to evaluate any concerns on their part concerning the performance of the contractor in producing the complete, timely, practi tioner portfolios. Continuing Medical Education: A 100% review on an annual basis of the Legal Medicine Journal for content, quiz and answers, and distribution list review will be performed to ensure the highest quality of quality assurance and risk management education for the military health system. Customer input will also be evaluated using an analysis of the evaluation form contained in each issue of Legal Medicine. Additionally contact with the military services, DoD Health Affairs, and the TriCare Management activit y will be used to gauge the quality of each issue as it is produced by the contractor. A quality assurance surveillance checklist will be used by the Department of Legal Medicine to record the inspection of these elements of performance by the contractor and stored at the Department of Legal Medicine. PERIOD OF PERFORMANCE. One year from date of award with four one year optional periods of performance. Contract Line Items (CLINS): Base Year  0001 All personnel costs anticipated for that period and other direct costs; Option I 0002 All personnel costs anticipated for that period and other direct costs; Option II 0003 All personnel costs anticipated for that period and other direct costs; Option III 0004 All personnel costs anticipated for that period and other direct costs and Option IV 0005 all personnel costs anticipated for that period and other direct costs. Offerors must accept Government Credit for payment. This is not a set-aside for small businesses. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous, representing the best value to the Government price and other factors considered. The following factors will be used to evaluate offers: (1) Personnel qualification and experience of same or similar work; (2) Past Experience with similar contracts of this magnitude; (3) Familiarity an d experience of the contractor with Military Health System in areas of Quality Assurance and Risk Management; (4) Favorable track record of past performance; (5) Price. Each offeror must (1) submit an offer, (2) submit a technical proposal that addresses the evaluation criteria . To evaluation evaluation criteria #2 vendor must identify all federal, state local or private contracts for which the offeror has performed work similar to the PWS in this solicitation. Include contracts within the last two years, including POCs and telephone numbers. This list is due on the established receipt date of proposals. Offerors are reminded to include a completed copy of the provision at 52.212-3 Offeror Representation and Certification-Commercial Items.
