- This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. MOBILE RADIOLOGY SERVICES General Information- The Federal Bureau of Prisons, Field Acquisition Office, Grand Prairie, Texas intends to award an indefinite delivery/ requirements type contract with firm-fixed unit prices to a responsible entity for the provision of mobile radiology services to be performed on-site at the Federal Correctional Institution (FCI) Williamsburg located in Salters, South Carolina. FCI Williamsburg is a medium security facility housing approximately 1285 federal male inmates. Additionally, FCI Williamsburg operates an adjacent minimum prison camp which houses approximately 140 minimum security male inmates. Additional information regarding the Federal Bureau of Prisons and FCI Williamsburg is located at www.bop.gov . Required Services- The purpose of this solicitation/ contract is to procure Mobile Magnetic Resonance Imaging (MRI) services and Mobile Computerized Tomography (CT) services. Upon receipt of a BOP referral for service, the contractor shall be responsible for the following: 1. Performing MRI of the brain, cervical, thoracic and lumbar spine in multiple views. 2. Performing MRI of various internal body organs. 3. Performing MRI of various joints such as elbow, knee, hip, ankle, etc. 4. Performing CT of the brain. 5. Performing CT of various internal body organs. 6. Provide professional interpretations by a Radiologist licensed in accordance with the laws and regulations of the state in which service is provided. Reports must be typewritten or in computerized format and returned to the Contracting Officers Technical Representative (COTR) within three (3) business days. Additionally, the contractor will be responsible for the expense of professional interpretations of all exams and the expense of shipping films and reports to FCI Williamsburg. 7. The contractor will be responsible for equipment transportation, delivery and set up of facility, tractors, trailers, drivers, complete maintenance/service coverage on all equipment, training and staffing insurance, site planning and consultation, support, etc. Mobile units must be capable of generating their own power to perform scans and the contractor will be responsible for obtaining their own electrical supplies. The services required are for a non-personal health care services type contract, as defined in the Federal Acquisition Regulation (FAR), Part 37.101, under which the contractor is an independent contractor. The Government may evaluate the quality of professional and administrative services provided, but retains no control over the medical and/or professional aspects of services rendered (i.e., professional judgements, diagnosis for specific medical treatment). The contractor is required to indemnify the Government for any liability producing act or omission by the contractor, its employees and agents occurring during contract performance. The contractor is required to ensure that all subcontracts for provision of health care services contain the FAR clause 52.237-7, including the maintenance of medical liability insurance. These services, although not directly supervised, will be under the administrative review of the Assistant Health Services Administrator and the designated Contract Officers Technical Representative (COTR). Equipment and Supplies- All necessary equipment, tools, and supplies required to perform the requested service will be furnished by the contractor. Equipment repairs are the sole responsibility of the contractor. In recognition of institution security concerns, the supplies and equipment used by the contractor may be subject to search upon entry or exit of the institution. The Government will furnish all required Government forms to be used in the performance of services. All records maintained by the contractor under this contract will remain the property of the BOP. Place of Performance - Mobile services will be provided on-site at FCI Williamsburg, 8301 Highway 521, Salters, South Carolina 29590. The contractor will sign a consultant log, indicating the date of visit to the institution, time of arrival, and time of departure. Minimum Qualification Requirements - The contractor must be registered and licensed with the proper authorities to provide required services. In addition, the personnel operating the equipment must be experienced and certified to perform requested studies and tests. The contractor must provide, with their quote, photocopies of documents evidencing all named providers abilities to perform required services in the State of South Carolina. Examples of documentary evidence include licenses, diplomas, certifications, etc. Performance Schedule -The contractor will normally conduct services six (6) times per year each for both MRI and CT exams. Each session of service is defined as one day in length, lasting approximately eight (8) hours. Sessions will generally be scheduled between the hours of 6:00 a.m. - 4:00 p.m. on a date mutually agreeable to the Government and contractor. Sessions will not be scheduled on federal holidays. The contractor will be notified in advance of the requested date of service, of the type of service, and the number of inmates to be examined. The number of inmates will be determined by the Health Service Staff and will vary. The contractor is advised that there will be time necessary to process contractor staff and equipment upon entry/exit of the institution. Due to the nature of the correctional setting, delays in performance of work may be expected. Such delays may include but are not limited to inclement weather, electrical or mechanical problems, or other security matters. When contract employees report to the institution but are unable to perform services due to such delays, the contractor may be entitled to compensation of his time. The contracting officer shall be responsible for negotiating fair and reasonable payment. In the event it becomes necessary for the Government to cancel a scheduled session, the FCI will attempt to provide the contractor with 48 hour written or verbal notice prior to cancelling a session. When advance notice is given, the Government will not be subject to payment for cancelled sessions. Restrictions on Contract Workers - The contractor shall not supervise inmates; supervise Bureau of Prisons staff; participate in inmate accountability; requisition, sign for, or pick up supplies; formulate policy or procedures; or attend meetings, staff recalls or staff functions. Inmate Management - The provision of services under this proposed contract will require frequent and unsupervised contact with inmates. The contractor will not be responsible for the management of inmates except to ensure that those inmates involved in activities within the contractors scope of work shall abide by all rules, in effect, to ensure the safety and well being of all participants. The contractor will report any infractions of rules and regulations by any inmate to the COTR. Institution Security - The contractor agrees to adhere to all regulations prescribed by the institutions in regards to the safety, custody, and conduct of inmates. The Bureau of Prisons requires all non-employees to sign in and out of the institution for security reasons. Additionally, contract staff will each be required to where an ID badge, provided by the Government, at all times within the confines of the FCI. The contractor will sign a consultant log, indicating the date of visit to the institution, time of arrival, and time of departure. The contractor will be provided with a security and BOP procedures orientation session, consisting of approximately four (4) hours, prior to performing any services under this contact. The date and time for this orientation will be mutually agreed upon by both parties, and reimbursement for attendance may be negotiated by the contracting officer. Refresher training in security and BOP procedures may be required annually. Compensation to the contractor for time spent in this, and any other required security related training, will be negotiated by the Contracting Officer. Method of Performance - The contractor has sole responsibility and discretion for choosing and implementing the manner and method of performing tasks outlined in this SOW as long as the requirements are met in accordance with the policies described above. The services required are for a non-personal health care services type contract, as defined in the Federal Acquisition Regulation (FAR), Part 37.101, under which the contractor is an independent contractor. Payment Terms - It is the preference of the FCI to be billed on a monthly basis. Invoices should be submitted in accordance with FAR 52.212-4(g) and payment will be rendered in accordance with the Prompt Payment Act (31 U.S.C. 3903). The contractor may offer discount payment terms for prompt payments as specified in Block 12 on the SF-1449 of this solicitation. CONTRACT PRICING - Contract pricing shall include all charges to the Government for performing the services required by this solicitation/contract (e.g., bonding, overhead, profit, supervision, minimum wages, etc.). The Government reserves the right to award without discussion. Therefore, the initial quote should contain the quoters best terms from a cost or price standpoint. Quoters are hereby notified that an offer of contract award shall be extended to the responsive/responsible quoter submitting the lowest priced, technically acceptable quote. PRICING METHODOLOGY - The quantity of services to be provided by the Contractor is estimated below and are not a representation to a quoter or contractor that the estimated quantities will be required or ordered or that conditions affecting requirements will be stable or normal. Pursuant to FAR 17.203(b), the Governments evaluation shall be inclusive of options. Pursuant to FAR 17.203(d), the quoter may offer varying prices for options, depending on the quantities actually ordered and the dates when ordered. OTHER CONTRACT TERMS AND CONDITIONS: Type of Contract: A resultant contract will be an indefinite delivery/requirements type contract with firm-fixed pricing. It is anticipated that contract award resulting from this solicitation will be made approximately August 15, 2006. Performance Period: The periods of performance of the resulting contract shall be Base Year - Effective Date of Award (EDOA) thru 12 months; Option Year 1 - 13 months from EDOA thru 24 months; Option Year 2 - 25 months from EDOA thru 36 months; Option Year 3 - 37 months from EDOA thru 48 months; Option Year 4 - 49 months from EDOA thru 60 months. The Contractor shall commence full performance of services under this contract within 30 calendar days from effective date of award of the contract. In accordance with FAR 46.503 and 46.403(a)(6), the place of acceptance for services under this contract is at the destination, FCI Williamsburg, located in Salters, South Carolina. Ordering Official: Task orders for service may be issued only by the Contracting Officer, Administrative Contracting Officer, or an ordering official for the institution with an appropriate certificate of appointment or a delegation of authority for commercial purchase card purchases. Security and Investigative Requirements: The following requirements apply to all individuals delivering services inside the institution. 1. National Crime Information Center (NCIC) check; 2. DOJ-99 (name check); 3. FD-258 (fingerprint check); 4. Law Enforcement Agency checks; 5. Vouchering of Employers over past five years; 6. Resume/Personal Qualifications; 7. OPM-329-A (authority of release of information); 8. NACI check (if applicable); and 9. Urinalysis test (for detection of marijuana and other drug usage). Each prospective contractor is advised that a urinalysis test is required as indicated above prior to performance If the proposed contract is with ,an individual, and if the test is positive, the proposed contractor shall be disqualified from being awarded the contract. If the proposed contract is with a company and the individual(s) assigned to perform the work tests positive, the individual(s) shall be excluded and the proposed contractor shall provide acceptable replacement personnel subject to the same security requirements. Contractor employees are allowed access to the institution at the sole discretion of the Warden of the institution. The Contractor agrees to adhere to all regulations prescribed by the institution in regards to the safety, custody, and conduct of inmates. The contractor shall be in compliance with 8 CFR 274a regarding employment of aliens. Contract workers shall be provided with a 4-hour security orientation program prior to performing any services at the institution. The date and time for this orientation will be mutually agreed upon by both parties and reimbursement for attendance will be at the current years session rate. Non-Personal Service Status: Award of this requirement will result in a contractual arrangement only and shall not be construed as a personnel appointment with the BOP. The services shall not constitute an employer/employee relationship. Payments to the Contractor shall be based on the provision of an end product or the accomplishment of a specific task. Results to be obtained are within the Contractors own unsupervised determination. The Contractor will not be subject to Government supervision but its efforts will be monitored for quality assurance.
