Description
The purpose of this Notice of Contracting Action (NOCA) is not to request competitive proposals, but to announce a pending contractual action. Under the authority of Title III of the Defense Production Act (DPA) (50 U.S.C. App.2061 et seq.), the Title III Program Office, Air Force Research Laboratory, Manufacturing Technology Division (AFRL/MLM), is contemplating a procurement to establish a long term domestic source for producing primary beryllium metal to meet Department of Defense needs. The government intends to release a solicitation for these requirements on a sole source basis, and contemplates awarding a cost share Technology Investment Agreement (TIA) with Brush Wellman Inc., 14710 W. Portage River South Rd., Elmore, OH 43416. The period of performance for the procurement is anticipated to be 72 months. The objective of this Title III program is to establish a domestic source to produce primary (high purity) beryllium metal for defense and commercial applications. Brush Wellman Inc. shall plan, design, permit, build, equip, qualify, and operate a beryllium reduction facility that is fully compliant with Environmental Protection Agency (EPA) and Occupational Safety and Health Administration (OSHA) regulations governing the manufacture of primary beryllium metal. Once operational, the beryllium reduction facility will convert beryllium hydroxide feedstock into primary beryllium metal. The new facility will be designed to produce beryllium capable of meeting DoD specifications for pure beryllium metal. Brush Wellman Inc. will work proactively with the National Institute for Occupational Safety and Health (NIOSH) to further the understanding of the hazards of manufacturing beryllium, as well as to ensure environmental compliance continues throughout the operational life of the facility. Only one responsible source and no other supplies or services will satisfy agency requirements as per the authority under 10 U.S.C. 2304(c)(1). Contractor's capable of offering this technology must respond within 15 days after publication of this notice by submitting a specific capability statement to provide this technology. All responses received within 15 days after publication of this notice will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete with this proposed contract based upon responses to this notice is solely within the discretion of the Government. See Numbered Note 22.
