- The U.S. EPA intends to negotiate on a sole source basis with BD Biosciences for a commercially available "off-the-shelf' Four (4) Laser Bench Top Flow Cytometer System (Blue, Red, Violet, Ultraviolet (UV)) under the authority of FAR Part 13.106-1 (b). This requirement for the ORD / NHEERL will utilize FAR Parts 12 and 13, Commercial and Simplified Acquisition Procedures. This acquisition is for one (1) Four (4) Laser Bench Top Flow Cytometer System (Blue, Red, Violet, Ultraviolet (UV)), to replace a Beckman Coulter EPICS XL/MCL flow cytometer, that meets the following minimum specifications: (1) HeNe (red) laser to permit the use of fluorescent probes and fluorochromes that are excited at the wavelength of 633-nm, (2) An expanded repertoire of available fluorescent dyes and probes for performing toxicological research with accessibility to both a UV laser (355-nm excitation) and a violet laser (407-nm excitation), (3) Access to Violet lasers in conjunction with the other lasers that will permit EPA to utilize the newly developed highly fluorescent particles called Quantum Dots, (4) Table/Bench to accommodate the specified Four (4) Laser Bench Top Flow Cytometer System and peripheral equipment, (5) Computer, Printer, Software, and Monitor capable of running the entire integrated instrument, with CD/DVD writer for data archiving, (6) Installation and test the entire system at the EPA NHEERL Laboratory to demonstrate that all specifications have been met, (7) Start-up and Training at EPA for a minimum of five (5) days, (8) On-site maintenance and/or repair warranty for one (1) year after acceptance, (9) Deliver the entire system FOB Destination, Research Triangle Park, North Carolina within 10 weeks after contract issuance, (10) Options for on-site maintenance and/or repair warranty for up to four (4) years after expiration or original warranty. The U.S. EPA believes that BD Biosciences is uniquely qualified to meet this requirement because market research indicates it is the only manufacturer of a Bench Top Four (4) Laser Flow Cytometer with four air-cooled lasers that meets the minimum specifications. Utilizing the BD Biosciences instrument allows EPA to correlate immunophentyping of cells with the measurement and monitoring of cell functionality using fluorescent probes, dyes, and fluorochromes which are excited by lasers other than the 488-nm argon laser. THIS NOTICE IS NOT A REQUEST FOR QUOTATION. However, any firm believing itself capable of providing the required instrument may submit technical documentation to establish its assertion. Such documentation must be submitted to the POC within 15 days of electronic posting of this notice. A determination not to compete the proposed requirement based upon responses received will normally be considered solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement or to proceed on a sole source basis.
