- (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in the notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) Solicitation #041702-058 (iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 14. (iv) This procurement is set-asided for Small Business. (v) Garbage Collection Services PROVIDE GARBAGE COLLECTION SERVICES FOR THE FEDERAL CORRECTIONAL INSTITUTION, MILAN, MICHIGAN AS STATED HEREIN: 1) 35 CU YARD SELF CONTAINED COMPACTOR 52 loads (FOOD SERVICE) 2) 30 CU YARD OPEN TOP DUMPSTER (GARAGE) 24 loads 3) 35 CU YD COMPACTOR (DETENTION CENTER) 24 loads 4) RESIDENTIAL HOUSES (12 EACH), WAREHOUSE, TRAINING BUILDING,. AND FIRING RANGE BUILDING, 52 weekly pickups 5) 42 CU YD COMPACTOR (UNICOR) 52 loads (Invoiced separatly) DESCRIPTION OF WORK: A. INSTITUTION SECURITY: The pick-up vehicle will be searched upon entry and departure. Delay is usually minimal; however, in the event of fog, severe weather or institution emergencies, the delay may exceed ONE hour. Under no circumstances shall the government be held responsible for any additional cost to the contractor which may occur due to the interruptions in pickup or due to fog/severe weather or institution emergencies. The driver will have to clear a NCIC prior to servicing the Institution. Upon clearance, the driver?s will present a current drivers license for entry to the Institution. If the driver does not have a valid driver license entry will be denied. Due to Institution security regulations, it is a Federal offense to bring onto the institution grounds any firearms, destructive devices, ammunition, or other objects designed to be used as a weapon, narcotic drugs, controlled substances, alcoholic beverages, currency, or other objects without the knowledge and consent of the Warden. B. AWARD REQUIREMENTS: In order to qualify for an award, the bidder must submit pricing on all the items. The award will be to the bidder whose offer conforms to the solicitation and will provide the best value to the Government, price and other price related factors considered, including past performance. The Government intends to award all to a single bidder C. PAYMENT REQUIREMENTS: Payment shall be made by Electronic Funds Transfer (EFT) or by Government credit card. ITEM NUMBER 5 (UNICOR) WILL BE BILLED AND SERVICED SEPARATELY. A SEPARATE ACCOUNT WILL BE ESTABLISHED FOR PAYMENT. Payment FOR ITEM 5 will be made by: Federal Prison Industries P.O.Box 600 Milan, Michigan 48160 POC: Nancy Keeler (734)439-1511 ext. 372 The Contractor shall ensure that all refuse is disposed of in accordance with state, local and federal regulations. The GOVERNMENT owns the two 35 cu.yd. self-contained compactors. The GOVERNMENT WILL BE responsible for maintenance and service. One (1) 35 cu.yd. self-contained compactor is located inside the secure perimeter of the Institution, behind Food Service. The compactor must be removed between 5:30 a.m. and no later than 6:00 a.m. and returned no later than 9:00 a.m. The compactor shall be serviced one (1) time weekly on Wednesday. The government reserves the right to call for additional pickups. One (1) 30 cu.yd. open top dumpster is located behind the Institution garage. The dumpster will be used for construction debris. The dumpster will be serviced approximately twice a month, an authorized government representative shall call for pick-up. One (1) 35 cu.yd. self-contained compactor is located behind the Federal Detention Center, just east of the institution. The compactor must be removed after 7:30 a.m. and returned no later than 10:00 a.m. The compactor shall be serviced twice monthly on the first and third Wednesday of the month. The government reserves the right to call for additional pickups. The residential housing area, outside warehouse & training center will be picked-up weekly on Wednesday. The twelve (12) residential units are located in front of the Institution. One (1) covered 6 cu.yd. dumpster shall be located at both the warehouse and at the training center; both are located south of the main institution. Note: located outside of security fencing. Section II: Federal Prison Industries (Unicor) (Inside Security Fencing) One (1) 42 cu.yd. self-contained compactor shall be located at the Unicor warehouse dock, which is located inside the secure perimeter of the Institution. The compactor must be removed between 5:30 a.m. and no later than 6:00 a.m. and returned no later than 9:00 a.m. The compactor will be serviced approximately three (3) times per month, and the government representative shall call for pick-up. F. POINTS OF CONTACT: The following staff members are authorized to contact the contractor to request service. Under no circumstances, will the Government be held responsible for unauthorized service. 1.)Federal Correctional Institution Peter J. Boss, Contract Specialist Jo Knitter, Inventory Management Specialist Dean Kottke, Maintenance Foureman Greg Bardell, Garage Foreman Tim Thatcher, Landscape Foreman Thomas Birchmeier, Preventive Maintenance 2.)Unicor Nancy Keeler, Contract Specialist Jim Schubering, Factory Manager This will be a Firm Fixed Price Contract. 52.216-18 Ordering (Oct 1995) (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by the individuals or activities designated. Such orders may be issued from October 01, 2004 through September 30, 2005 . (b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control. (c) If mailed, a delivery order or task order is considered issued when the Government deposits the order in the mail. Orders may be issued orally, by facsimile, or by electronic commerce methods only if authorized in the Schedule. (End of clause) 52.216-19 Order Limitations (Oct 1995) (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than 20 sessions, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor- (1) Any order for a single item in excess of items listed in (iv) ; (c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section. (d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 3 days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. (End of clause) 52.216-21 Requirements (Oct 1995) (a) This is a requirements contract for the supplies or services specified, and effective for the period stated, in the Schedule. The quantities of supplies or services specified in the Schedule are estimates only and are not purchased by this contract. Except as this contract may otherwise provide, if the Government's requirements do not result in orders in the quantities described as estimated or maximum in the Schedule, that fact shall not constitute the basis for an equitable price adjustment. (b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations. (c) Except as this contract otherwise provides, the Government shall order from the Contractor all the supplies or services specified in the Schedule that are required to be purchased by the Government activity or activities specified in the Schedule. (d) The Government is not required to purchase from the Contractor requirements in excess of any limit on total orders under this contract. (e) If the Government urgently requires delivery of any quantity of an item before the earliest date that delivery may be specified under this contract, and if the Contractor will not accept an order providing for the accelerated delivery, the Government may acquire the urgently required goods or services from another source. (f) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after September 30, 2005. (End of clause) DELIVERY DRIVERS MUST PASS SECURITY BACKGROUND CHECKS, WHICH MAY INCLUDE BUT LIMITED TO: (1) URINALYSIS (2) NCIC (3) NACI (4) DOJ-99, NAME CHECK (5) FD-258, FINGERPRINT CHECK (6) LAW ENFORCEMENT CHECK (7) VOUCHERING OF PAST EMPLOYERS (8) OPM-329-1, RELEASE OF INFORMATION REIMBURSEMENT FOR TIME SPENT IN REQUIRED TRAINING ONLY UPON COMPLETION AND PASSING OF ALL CHECKS. THE SERVICE REQUIRED IS ON A CONTRACTUAL BASIS. THIS IS NOT A PERSONNEL APPOINTMENT. THE SERVICE DOES NOT CONSTITUTE AND EMPLOYER/EMPLOYEE RELATIONSHIP. PAYMENT IS BASED UPON THE PROVISION OF AN END PRODUCT OR THE SPECIFIC ACCOMPLISHMENT OF A SPECIFIC SERVICE. THE CONTRACTOR WILL NOT BE SUBJECT TO GOVERNMENT SUPERVISION, EXCEPT FOR SECURITY RELATED MATTERS. HOWEVER, THE CONTRACTOR'S PERFORMANCE SHALL BE CLOSELY MONITORED BY AN APPOINTED CONTRACTING OFFICERS TECHNICAL REPRESENTATIVE. UNDER THIS CONTRACT TOM BIRCHMEIER WILL ACT AS COTR. (vi)Contractor must be registered with Dun and Bradstreet. Payment will be by Electronic Funds Transfer only. NO FEDERAL HOLIDAYS. (vii) Delivery to within 15 days of date of order, FOB Milan, Michigan, (Destination) (viii) The provisions at 52.212-1, Instructions to Offers-Commercial, applies to this acquisition. (ix) 52.212-2, Evaluation - Commercial Items, - Price (x) Offerors are to provide a copy of 52.212-3, Offeror Representations and Certifications-Commercial Items, with offer.
