- CONTRACTING OFFICE ADDRESS Department of Justice, Field Acquisition Office, Armed Forces Reserve Center, 346 Marine Forces Drive, Grand Prairie, TX 75051 DESCRIPTION RFQ 30106-1045-4 is issued as a Request for Quotation for commercial items in accordance with the format in Federal Acquisition (FAR) subpart 12.6, Streamlined Procedures for Evaluation and Solicitation for Commercial Items as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued. The solicitation document and incorporated provisions are those in effect through Federal Acquisition Circular 2001-24. This action is unrestricted. The North American Industrial Classification System Code is 424490 with a size standard of 500 employees. The Government intends to make a single award of a fixed price, requirements type contract with firm-fixed unit pricing for the provision of various fountain drink products and equipment for the United States Penitentiary (USP) and the Federal Prison Camp (FPC) located in Atlanta, Georgia. Award will be made to the quoter who submits the most advantageous offer to the Government based on price and other factors. Faith-Based and Community-Based Organizations have the right to submit quotes equally with other organizations for contracts for which they are eligible. GENERAL REQUIREMENTS: The Federal Bureau of Prisons (BOP), United States Penitentiary (USP) and Federal Prison Camp (FPC), located at 601 McDonough Blvd, S.E., Atlanta, Georgia 30315, has a requirement for the supply of various fountain beverages and equipment for the period of a base year with four (4) twelve (12) month option periods for renewal. Award is estimated to be on or about September 1, 2004, with the effective award date estimated to be October 1, 2004. Equipment All beverages required will be dispensed by a bag-in-box dispensing system supplied and maintained by the vendor. The contractor shall provide and install refrigerated soda dispensing units with 2, 6, or 8 spigots and ice bins. Dispensing units shall include all miscellaneous equipment (i.e. pumps, chillers, carbonators, gauges, flex lines, fittings, etc.). The USP/FPC may request, at any time throughout the life of the contract, additional equipment or current equipment removed as necessary. All equipment provided shall remain the property of the contractor and shall be retrieved at the contractor's expense upon completion of the resulting contract. For the initial start-up of the contract, the following are estimated quantities of equipment that shall be installed by the contractor. Refrigerated Soda Dispensing Unit with six spigots and a 150 lb Ice Bin (Hopper): 6 Refrigerated Soda Dispensing Unit with eight spigots and a 200-250 lb Ice Bin (Hopper): 4 Refrigerated Soda Dispensing Unit with two spigots and a 50 lb Ice Bin (Hopper): 2 Contractor shall deliver and have equipment operational within 30 calendar days from date of award of the contract. Ordering of products by the USP/FPC shall not begin prior to October 1, 2004. Repair Services Repair services on the equipment supplied by the contractor shall be provided throughout the life of the contract at no additional cost. All repairs must be made within 24 hours upon notification. Requests for repairs will be made by the Food Service Administrator and/or his designee. Supplies The contractor shall provide 5 gallon and 2.5 gallon non-alcoholic, non carbonated, liquid concentrate, bag-in-box (BIB) beverages. Flavors shall include but not be limited to the following: cola, diet cola, lemon lime, cherry cola, root beer, and iced tea. The contractor shall also provide a complete listing of flavors that will be available at the contract price. FAR 52.211-6, Brand Name or Equal has been included in this requirement. Offerors shall provide a product which is equal in level of quality to that of brand names: Coke, Pepsi, Dr. Pepper/7UP. Salient characteristics are that the product must be a non-alcoholic, non-carbonated, liquid concentrate with an appealing taste and a verifiable record of having been served successfully to the general public. The vendor shall include the CO2 required in the cost of the product and not charge for this necessity on a per unit basis. The CO2 is viewed as a means to dispense the product and not an additional product for consumption. Delivery Order Information The USP/FPC will place orders for products as needed with deliveries being conducted a minimum of once per week. Delivery orders may be issued only by a Contracting Officer at the USP/FPC. Product shall be delivered Monday through Friday with the exception of Federal Holidays and no later than five working days after receipt of an order. Deliveries shall be made to the USP/FPC, 601 McDonough Boulevard, S.E., Atlanta, Georgia, 30315. Place of acceptance shall be at the destination, USP/FPC. Any resulting contract shall be an indefinite delivery/requirements contract. As such, quantities listed are estimates only and are not a representation to an offeror or contractor that the estimated quantities will be required or ordered or that conditions affecting requirements will be stable or normal. Pursuant to FAR 17.203(b), the Government?s evaluation shall be inclusive of options. Pursuant to FAR 17.203(d), quoters are permitted to vary unit prices for options. Special Requirements All machines furnished hereunder shall be equipped with all necessary safety devices listed by Underwriter?s Laboratories Inc. and be equipped so as to provide thermal overload protection. All product dispensing machines furnished must be approved by the National Sanitation Foundation or other approved testing organization. The contractor assumes full risk of and responsibility for any loss, destruction or damage occurring to the dispensing machines except such loss or damage as may be attributable to the Bureau of Prisons by reason of negligence of its employees while acting within the scope of their employment. Schedule of Required Insurance: As required by FAR clause 52.228-5 entitled ?Insurance - Work on a Government Installation,? the contractor shall, at its own expense, provide and maintain during the entire performance of the resulting contract, at least the kinds and minimum amounts of insurance as follows: Workers? Compensation: the contractor shall comply with applicable Federal and State workers? compensation and occupational disease statutes - if occupational diseases are not compensable under those statutes, employer?s liability coverage of at least $100,000 is required; Comprehensive General Liability $500,000 per occurrence; Automobile Liability: $200,000 per person, $500,000 per occurrence for bodily injury, and $20,000 per occurrence for property damage. EVALUATION OF QUOTATIONS: The Government will make award based on technical compliance, past performance, and price. Past Performance A quoter shall include a list of the ten most recent current of complete contracts and subcontracts occurring during the past three years. Contracts listed may include those entered into with the Federal Government, agencies of state and local government, and commercial entities. Quoters that are newly formed entities without prior contract should list contracts and subcontracts as required above for all key personnel. Quoters should provide a point of contact, address, and phone number for each contract. The quoter may provide information on problems encountered on the contracts and subcontracts identified and may describe corrective actions taken to resolve those problems. Quoters should not provide general information on their performance on the identified contracts. General performance information will be obtained by the Government from the references. Each quoter will be evaluated on its performance under existing and prior contracts for similar products or services. Performance information will be used for both responsibility determinations and as an evaluation factor against which quoters? relative rankings will be compared to assure best value to the Government. The Government will focus on information that demonstrates quality of performance relative to the size and complexity of the procurement under consideration. Past performance will be scored and the Government?s conclusions about overall quality of the quoter?s past performance will be highly influential in determining the relative merits of the quotation and in selecting the quotation considered most advantageous to the Government. The Government reserves the right to use past performance information obtained from other than the sources identified by the quoter. Information may be utilized from the references provided in the quotation, other customers known to the BOP, consumer protection organizations, and other who may have useful and relevant information. Information may also be considered regarding any significant subcontractor and key personnel records. The Government will evaluate the quality of the quoter?s past performance. The assessment of the quoter?s past performance will be used as a means of evaluating the relative capacity of the quoter and the other competitors. Consequently, a quoter with an exceptional record of past performance may receive a more favorable evaluation than another whose record is acceptable. If a quoter, or the proposed employees for the quoter, do not have a past performance history relating to this solicitation, the quoter will not be evaluated favorably or unfavorably on this factor. Evaluation of past performance will be a subjective assessment based on consideration of all relevant facts and circumstances. It will not be on absolute standards of acceptable performance. The Government is seeking to determine whether the quoter has consistently demonstrated a commitment to customer satisfaction and timely delivery of services/supplies at fair and reasonable prices. This is a matter of judgment. Quoters may be given an opportunity to address especially unfavorable reports of past performance, and the quoter?s response, or lack of, will be taken into consideration. A quoter?s opportunity to address reports of negative past performance information could be affected by the Government?s entitlement to award without discussions. Quoters would be well served to be aware of possible dissatisfied customers and address expected negative issues in the initial quotation. Generally, negative information obtained from a quoter?s references is considered historical in nature, not subject to change, and not a matter for discussions. By evaluating past performance, the Government intends to consider the quoter?s record of conforming to specifications and to standards of good workmanship; the quoter?s adherence to contract schedules, including administrative aspects of performance; the quoter?s reputation for reasonable and cooperative behavior and commitment to customer satisfaction; and generally, the quoter?s business-like concern for the interest of the customer. Past performance subfactors to be evaluated are: quality of product or service; timeliness of performance; business relations; and customer satisfaction. SUBMISSION OF QUOTATIONS: Quotations shall be submitted on or before the quotation deadline specified below. All responsible sources may submit a quotation. Quoters will be required to submit the following information on letterhead or business stationery, directly to the contracting officer. 1. Completed Schedule of Items 2. All quoters are advised that this solicitation includes the clause at FAR 52.212-4 for commercial items which at paragraph (t), Central Contractor Registration (CCR), requires all contractors doing business with the Federal Government after September 30, 2003, to be registered in the CCR database. Quoters should include their Data Universal Number System (DUNS) number in their quotes. The Contracting Officer will verify registration in the CCR database prior to award by entering the potential awardee?s DUNS number into the CCR database. Failure to complete the registration procedures outlined in this clause may result in elimination from consideration for award.
