- 17. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. Submit offers on RFQ4053. This solicitation and its incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 01-24. This acquisition will be processed under Simplified Acquisition Procedures (SAP) and is not a Small Business Set-Aside. The associated North American Industry Classification System (NAICS) Code for this acquisition is 541211 and the small-business size is $7 million. SCHEDULE: The NIAID requires services from an auditing firm to provide a review of sales records in order to determine if the National Institutes of Health (NIH) has received proper royalty payment for use of licensed NIH technologies. In addition, NIAID requires the assurance that the licensee is in compliance with the terms of the subject license agreements. The selected source will provide these services by providing a certified public accountant or like person, to examine records of all sales and/or licensed products under the subject licenses granted. The period of performance will be three (3) months from after receipt of order. This is a firm-fixed-price contract. The FAR provisions and clauses that apply to this acquisition: FAR 52.212-1 Instructions to Offerors - Commercial Items; FAR 52.212-2 Evaluation - Commercial Item; FAR 52.212-3 Offerors Representations and Certifications - Commercial Items; FAR 52.212-4 Contractor Terms and Conditions - Commercial Items; FAR 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Commercial Items ? Commercial Items; and FAR 52.204-7 Central Contractor Registration. Offerors shall include with their offer a completed copy of provisions at FAR 52.212-3; Offerors Representations and Certifications - Commercial Items. The Government intends to select the offer that represents the best value to the Government, price and all other factors considered. The evaluation criteria will be based on technical capability and price. The technical capability will be assessed using the following point system: (35 Points) 1. Understanding of the auditing requirement and proposed technical approach to conducting the necessary royalty audit; understanding internal billing procedures, including assignment and management methodology used during the initial evaluation and in determining if further investigation is necessary; and assurance that no conflict of interests persist and that such conflicts are avoided throughout performance of the requirement. (35 Points) 2. Personnel: qualifications of proposed staff; suitability and adequacy of each auditor (provide names, telephone numbers and contact persons for each auditor as well as other supporting documentation) proposed with regard to education, training and experience in conducting royalty audits; availability of proposed personnel for assignment to this project. By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
