Description
This amendment to the solicitation provides answers to Contractor's questions, revises the PWS, reduces the number of estimated hours to 164 hours, changes the performance period to 15 April through 30 September 2004, and sets the new closing date to 12 April 2004 at 9:00 a.m. Question 1. Can FAA Part 91 operators be awarded this contract. If yes, what is the priority/criteria to schedule missions with 91 vs. 135 operators? Answer - No, the contractors must meet the DODI 4500.53 requirements. Question 2. Insurance Requirements: a. Paragraph 1.6.1 defines a Combat Equipped Jumper as "an aircraft passenger." Question 2a: Does the government require passenger insurance for all operators under this contract? Answer 2a. If they exceed the 25 mile limit from point of takeoff they will require seating and insurance IAW DODD. However, the PWS has changed and the Goverment will not require the contractor to fly a mission which will exceed 25 miles. b. If no passenger insurance requirements, is the Government aware that the FAA requires 135 operators to have passenger insurance but not 91 operators? Answer 2b - Yes c. Because most of this work is done on Military installations, are there any other insurance requirements (i.e. 52.228-5) specified by this contract. Answer 2c. The minimum amounts of insurance required in accordance with 52.228-5 ?Insurance-Work on a Government Installation? are as follows: Type: Automobile Bodily Injury Liability, Amount: $200,000 per person/$500,000 per occurrence; Type: Property Damage Liability, Amount: $20,000 per occurrence; Type: Workers Compensation & Occupational Disease, Amount: As required by Federal and State Statutes; Type: Employer?s Liability, Amount: $100,000. 3. Paragraph 1.1, Scope of Work provides references by which to operate. a. Please provide a copy or a way to get a copy of "Under Secretary of Defense Memorandum, Requirements for Airdrop Operations, 31 Jan 03" Answer 3a. As I can not attach the file, please email me a separate request and forward it via email. b. AR 95-1 is a broad guide for operation of Army aircraft. What portion of AR 95-1 pertains to this contract? Answer 3b: None known. 4. Question: Paragraph 1.5.2, Required Briefings, states "For Air Support Services involving passenger operations, a briefing shall be conducted in accordance with Federal Aviation Regulation 135.117." Because Para 1.6.1 basically defines all personnel as passengers, is this 135.117 briefing required for all missions? Answer 4. It is the most complete, but if doing parachute operations items must be added for the type of mission. 5. ....have a Lockheed C-130 that we would like to use on this contract. We will have to operate the aircraft as a Public Aircraft under a single Government Contract and the aircraft would only fly for this contract, basing out of Fayetteville, NC. This C-130 is configured the same as the current C-130s operated by the military and could provide a smooth transition from training to actual conditions. My question is would this aircraft be acceptable to use on this contract. Answer 5. The Government must inspect and approve public aircraft. All responses will be considered. 6. Para 1.2 has a link to the regs needed for the performance of this contract. The link https://asociweb.soc.mil/hqs-asoc/dcssoa/standards.htm does not work. Is there another workable link? http://asociweb.soc.mil/hqs-asoc/dcssoa/standard.htm - the site without the s at the end of http. If unable, go to the ASOC website, select DCSSOA from the applets on the left side, then select standards and you will be on the correct site. 7. Para 1.5.3.2 and 1.5.3.3 requires "approved side foldup seats." Question 7. What is an approved seat? Answer 7. It is a seat that has been approved for passenger transport from point A to B by the administrator FAA. Question 8. Does this grant the waiver requirement if the mission is outside 25 miles as stated in para 1.7 c? Answer 8. However, the Performance Work Statement is revised to state: The Government will not require the contractor to fly any missions which exceed 25 miles. Question 9. Para 1.7 a imposes a 25 mile rule. Is this a hard rule, max of 25 miles or will this be adjusted to accommodate certain missions? Answer 9. 25 mile rule is in effect, no adjustments authorized until a deviation is approved by AMC and/or FAA. However, the PWS has been changed, no flights will exceed 25 miles. Question 10. Is this solicitation for all units under USASOC? Answer 10 - No, this solicitation is only to support USAJFKSWCS. Question 11 - Can the solicitation be amended to allow all missions to be performed under Part 91 regulations as public use aircraft rather than under Part 135 commercial regulations? Answer 11 - No, compliance with the DoD regulation is required. The revised PWS follows: 1. GENERAL. 1.1. SCOPE OF WORK. The contractor shall provide all direct labor, material, transportation, supervision, fixed wing aircraft, administration requirements for conducting air operations and all other items and services (not specifically identified herein to be Government-furnished), necessary to perform Air Support Services for Government directed parachute operations in accordance with DOD Directive 4500.53, Under Secretary of Defense Memorandum, Requirements for Airdrop Operations, 31 Jan 03, Army Regulation (AR) 95-1, USSOCOM Directive 350-8, Fort Bragg Aviation Standard Operating Procedures (SOP), Code of Federal Avaition Regulations (CFAR) Part 91, 105, and 119 as applicable, USASOC Supplement to AR 95-1, (CFAR) Part 135/AMC/SOA and USASOC Policy, as applies, for U.S. Army John F. Kennedy Special Warfare Center and School (USAJFKSWCS), at Shannon Airfield, Fort AP Hill, VA, Fort Bragg, North Carolina and other sites in the Southeastern U.S. as designated by the Government. The contractor shall perform to the standards specified throughout this PWS and the standard generally acceptable to the commercial Aviation Industry performing related or similar requirements. 1.2. SPECIFICATIONS. Air Support Services support shall be provided as an augmentation to Air Support Operations (ASO) conducted by U.S. Government-owned [military] Government operated aviation assets. The schedule of Air Support Services shall be provided to the contractor by an authorized Government representative as is required to satisfy USAJFKSWCS mission needs and in accordance with USASOC Policy. This requirement shall necessitate a commiserate degree of flexibility on the part of the contractor with regard to aircraft operations and workload scheduling, mission/flight preparations and the actual execution of the performance and performance quality of the services iterated throughout this PWS. Contract performance and performance quality shall strictly adhere to the Directives, Regulations and Guidance iterated in paragraph 1.1. and elsewhere throughout this PWS. The unique mission/flight parameters (as governed by Government-provided Programs of Instruction (POI) related to the parachute operations to be conducted) and strict aviation safety requirements required for contract performance shall necessitate to the contractor to provide fixed wing aircraft with side door or ramp capability. 1.2.1. MISSION/FLIGHT ITERATION CANCELLATION. The Government shall make every attempt to provide the contractor with seven (7) working days notice of a scheduled mission/flight iteration to be performed under the contract. However, the Government reserves the right to make notice of a scheduled mission/flight iteration with less notice. In the event the Government schedules a mission/flight iteration and subsequently cancels the same, for example, in the advent of unforeseeable inclement weather condition changes, cancellation shall be effected by the contractor at no additional cost to the Government. One exception to the aforementioned policy shall be enforced. Government notification of a cancelled a mission/flight iteration relayed to the contractor after the contractor?s aircraft have taken-off from the contractor?s principle base of aviation operations shall incur a late cancellation fee. This fee shall not exceed the cost of Air Support Operations for two (2) hours of service as prescribed in the Contract Line Item Number (CLIN) on the Schedule of Supplies/Services of the contract. 1.3. CONTRACTOR PERSONNEL. The contractor shall ensure employees engaged in Air Support Services (e.g., pilots), have current and valid professional qualification and certifications to satisfy all the requisite Federal Aviation Administration Federal Aviation Regulations. These qualifications shall be maintained for the term of the contract and shall be made available for inspection upon request of the Contracting Officer (KO) or the Contracting Officer?s Representation (COR), or other authorized Government representative. 1.4. HOURS OF OPERATION. Actual performance mission/flight iterations with regard to Air Support Service often entails performance at night, on weekends and possibly Federal Holidays. The flight times will be coordinated with the Government Representative. 1.5. MISSION/FLIGHT OPERATIONS. Mission/flight iterations shall vary throughout the term of the contract. However, no mission will require the contractor to exceed 25 miles. Typical mission/flight iterations are conducted in support of the Air Support Service operations, and administration thereto, of Military Free Fall HALO Jumps, Parachute Field Training Exercises, Bundle Drops, Proficiency Static-Line Airborne Parachute Operations and the like, at the various drop zones on Fort AP Hill, Fort Bragg, and other sites as designated by the Government. Some mission/flight iterations may require simultaneous operation of as many as two (2) aircraft. The actual dates, times and mission/flight parameters for Air Support Service operations shall require close-on coordinated between the contractor?s Project Manager and the COR, Jump Master, Drop Zone Safety Officer or other authorized Government representative, as required. The contractor is reminded, in no case, shall work be perform that is outside the scope of the contract, or that exceeds the total amount of hours per the Schedule of Supplies/Services on this contract, without prior written authorization from the Contracting Officer. 1.5.1. AIRCRAFT INSPECTIONS. With regard to the contractor?s aircraft utilized for Air Support Services the contractor shall make the following data available for Government inspection, the type of aircraft maintenance program used, airframe and engine logbooks, airworthiness certificate, radio station license, registration, operator?s handbook, weight and balance records and a list of tail number(s). Other aviation related contractor records and reports, as may be pertinent to the performance and performance quality for Air Support Services, shall be made available to the Government upon request. 1.5.2. REQUIRED BRIEFINGS. The contractor?s pilot(s) shall ensure pre and post mission/flight briefings are conducted as required by USASOC Regulations, Policies, and Field Manual 57-220. For Air Support Services involving passenger operations, a briefing shall be conducted in accordance with Federal Aviation Regulation 135.117. 1.5.3. MISSION/FLIGHT PARAMETERS AND SPECIFIC TASKS. The following mission/flight operating tasks, or parameters, are typical of the Air Support Services the contractor shall be expected to perform under the contract. The contract shall note this is not intended to be an all inclusive list of Air Support Service operations. It also is not intended as an absolute definition of each mission/flight parameters relative to each iteration conducted. In fact, mission/flight parameters shall be tailored, by an authorized Government representative, for each iteration scheduled, to meet USAJFKSWCS mission needs, and as such, may differ in detail from those outlined below. The Government requirements will not require the contractor to fly a mission which exceeds 25 miles. 1.5.3.1. Air Operations Practical Exercises (AOPE). AOPE operations shall consist of para-drops of equipment bundles and personnel (both day and night), and landing zone (LZ) operations at various small field landing strips (both day and night) that have been marked for landing. During the conduct of these operations, the contractor shall utilize aircraft landing light(s). The Contractor shall ensure that the aircraft have the capability to talk with the ground party running the operation via approved VHF and/or UHF frequencies. The aircraft shall be configured to allow a military static line airborne exit of the aircraft whether through a side door or ramp with a linear anchor line cable that runs the length of the aircraft so as to support 20 combat equipped jumpers. The estimated time to complete this operation is seven hours. 1.5.3.2. Practice Airborne Infiltration Operations (PAIO). PAIO operations shall incorporate aircraft that have a minimum of 15 seats installed (approved side fold-up seats) and with an allowable cabin load capable for transporting fifteen (15) combat equipped jumpers with two (2) non-combat equipped personnel. There will be between 150-200 total jumpers. The aircraft shall be configured to allow military static line airborne exit of the aircraft whether through a side door or ramp with a linear anchor line cable that runs the length of the aircraft so as to support 20 combat equipped jumpers per mission/flight iteration. This operation is normally conducted during nighttime. Pilots flying this operation shall brief the flight routes to personnel that will be jumping. The Contractor shall ensure that the aircraft shall have the capability to talk with the ground party running the operation via approved VHF and/or UHF frequencies. The estimated time to complete this operation is seven hours. 1.5.3.3. Robin Sage Airborne Infiltration Operations (RSAIO). With regard to RSAIO, every effort will be made to utilize military aircraft. However, in the event that military aircraft are not available, the contractor shall provide Air Support Services, to include, providing an aircraft type capable of supporting RSAIO requirements. The aircraft shall have a minimum of 15 seats installed (approved side fold-up seats) and with an allowable cabin load capable of transporting fifteen (15) combat equipped jumpers with two (2) non-combat equipped personnel. The Contractor shall ensure that the aircraft have the capability to talk with the ground party running the operation via approved VHF and/or UHF frequencies. The aircraft shall be configured to allow military static line airborne exit of the aircraft whether through a side door or ramp. The aircraft shall be able to complete two (2) 1,500 FEET above ground level lifts before having to refuel. This operation is normally conducted during nighttime. The estimated time that is required to complete this operation is six hours. The contractor?s pilots shall brief the flight routes to personnel that will be jumping. 1.5.3.4. Robin Sage Re-supply Bundle Drop (RSRBD). For this operation, the aircraft shall be required to perform static line para-drops of equipment bundles onto drop zones from an altitude of 500 FEET above ground level. This operation is conducted for up to two (2) consecutive nights. Two (2) military personnel will spot the drop zones and push the bundles out of the aircraft. The drop zones will be marked with a standard NATO ?L?. The aircraft shall be capable of dropping six (6) to ten (10) bundles with two (2) lifts each night mission/flight operations are scheduled. The estimated time that is required to complete this operation is four (4) hours for each night. The bundles will not exceed 400 pounds each. Minimum door size to accommodate bundle drops shall be 60 inches wide. The estimated time to complete this operation is seven hours. 1.5.3.5. Robin Sage Landing Zone Operations (RSLZO). For this operation, the aircraft shall perform LZ operations under the conditions iterated for AOPE operations. The operation will consist of a mix of LZ operations of approximately twelve (12) separate landing/take-off?s and passenger transport. This operation shall be conducted in accordance with FAR Part 135. The aircraft shall also be required to have the capability to talk with the ground party running the operation via approved VHF and/or UHF frequencies. The estimated time to complete this operation is seven hours. 1.5.3.6. Cadre Train-up (CT). For this operation, the contractor shall be required to perform para-drops of equipment bundles and personnel (both static line and HALO) (both day and night), and perform LZ operations under the conditions iterated for AOPE. During the conduct of these operations, the aircraft shall utilize aircraft landing light(s). The aircraft shall also be required to have the capability to talk with the ground party running the operation via approved VHF and/or UHF frequencies. The estimated time to complete this operation is seven hours. 1.6. COMMON AIR SUPPORT SERVICE DEFINITIONS. 1.6.1. COMBAT EQUIPPED JUMPER. An aircraft passenger (e.g., military parachutist, or other Government designee, in training or qualification jump status), rigged with a main parachute, reserve parachute, weapon, and ALICE-pack (back-pack) to parachute from an aircraft. The planning weight for a combat equipped jumper is as follows: Weight of average jumper is 200lbs, weight of parachute with reserve chute is 40lbs, and the weight of ALICE-pack and weapon is 80lbs. The total average planning weight per Combat Equipped Jumper is 320lbs. 1.6.2. PARADROP EQUIPMENT BUNDLE. Paradrop bundles are composed of equipment packed into a canvas container. The maximum container dimensions are 30"x 66"x 48". The bundle is dropped using a static line deployed parachute. Bundles are rigged in such a manner that when placed on the balance point of the jump platform, the parachute is on the top of the bundle or on the side of the bundle facing the center of the aircraft, based on the largest dimension. The maximum weight of each bundle is 400lbs. 1.7. AVIATION ADMINISTRATION/OPERATIONS. The contractor shall provide aviation assets with regard to Air Support Services performed under the contract in accordance with FAR PART 135 (et. al.), as applicable, to wit: (Operations are subject to on-site and/or ramp inspections). a. Operations under FAR Part 91 shall be for aviation support provided for ?parachute operations? only. No transportation of DOD personnel or cargo in excess of a 25 statute mile radius of the airport/field of takeoff shall be provided by aviation contractors/vendors under Part 91. Any operations other than that stated in this paragraph shall also require operations under FAR Part 121 or 135 in accordance with Department of Defense Directive (DOD) 4500.53 and will comply with sub-paragraph b. thru d, below. b. Operations under FAR Part 121 or 135 shall be in accordance with the contract, Federal Aviation Administration (FAA) issued operation specifications and appropriate FAR Part(s) for contracted certificate requirements, utilizing aircraft listed on the contractor/vendor operation specifications as issued to the contracted certificate holder by the FAA Administrator or designated representative. c. Operations under FAR Part 121 or 135 shall be in accordance with the appropriate FAR Part 121 or 135 requirements for use of safety belts and child restraint systems, deviations from this or any other requirement must be requested through USASOC (Director, Special Operations Aviation, AOAO), via the COTR, for approval prior to submission to the FAA Administrator in accordance with FAR Part 119.55. d. Airport/field lighting requirements for aircraft carrying passengers at night may not take off from, or land on, an airport/field unless lighting requirements meet the most stringent requirements of the following; FAR, DOD regulations/directives, Department of the Army, or USASOC/USAJFKSWCS policies, precedence, or standard operating procedures for aviation operations. The contractor shall be responsible for verification of the above established contract requirement. e. Government operations utilizing Public/Commercial Aircraft, as defined in the FAR, shall specifically be approved by USASOC (Director, Special Operations Aviation, AOAO). If the requested operation utilizing a Public Aircraft is approved, contractors/vendors utilizing said Public Aircraft will comply with all FAR, Department of the Army, USSOCOM, USASOC and USAJFKSWCS policies, precedence, and standard operating procedures. f. Operations under FAR PART 91, 121, or 135 require approval from USASOC, SOA, of programs developed utilizing special equipment or systems not otherwise provided oversight or enforcement by the FAA (i.e. Night Vision Devises/Goggles, Forward Looking Infra-Red). The programs developed must meet the U.S. Army and USASOC requirements for qualification, currency and continuation/sustainment training. Equipment utilized will be maintained and inspected IAW manufacturers established procedures; if none exist, these procedures will be established by the contractor/vendor and approved by USASOC, SOA. USASOC, SOA, will inspect all programs under this paragraph at least annually. C.1.8. GOVERNMENT-FURNISHED PROPERTY. The Government shall not provide any Government Furnished Property, to include aviation fuel, during performance of the contract. C.1.9. INVOICES: Submit a copy of the invoice to the COR, at USA JFK Special Warfare Center and School, Attn: 1ST SWTG(A), Commander, MAJ Sadler, S3, Bldg. 3004, Ardennes Street, Fort Bragg, NC 28310.
