Description
Amendment 0004 The closing date of the solicitation is hereby extended to 1700 Baghdad time on 2 April 2004. In verbal communications with potential offerors, the contracting officer indicated that the Berry Amendment, which applies to this solicitation, only requires that the cloth be manufactured in the U.S.A. Even though offerors were advised to contact their own attorney with regard to the Berry Amendment, in a sense of fair play the solicitation is extended. The Berry Amendment requires that the fibers are made or grown in the U.S.A., and the cloth and the end-item are manufactured in the U.S.A. The legislative history notes that this was the intention of Congress as conveyed below: "The Committee notes that it has long been the intent of Congress that this provision covers not only fabrics and apparel themselves but also all stages of textile production and all types of textile products, including manufactured articles. The Committee further notes that synthetic fabric fuel containers for military aircraft are included within the coverage of this provision and directs the Secretary to instruct the relevant offices within the Department of Defense to take note of this and ensure that Department procurements are consistent with the requirements of this provision." S.Rep. No. 154, 102d Cong., 1st Sess. 368 (1992). According, please submit revised prices, certification from the textile manufacturer that the cloth is produce from U.S.A. fibers and the place of manufacture of the end item. All offerors are reminded that they must comply with all solicitation requirements and amendments.
