- NA This is a Combined Synopsis/Solicitation for the turning of brake drums (Meritor PN 3219S4829) for a 5-Ton 939 Series Truck prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This a nnouncement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. This solicitation number DAHA22-04-T-0004 is issued as a Request for Proposal. The solicitation and incorporated provisions and cl auses are in effect through Federal Acquisition Circular 01-15. This solicitation is 100% small business set aside and is restricted to small businesses only in accordance with FAR 19.502-2(b). NAICS is 811111, Small Business Standard is $6,000,000. The resultant contract will be a performance-based requirements contract, base year with option to extend the contract one additional year. Individual task orders shall be placed against the contract when the Government has a requirement for the services. It em 0001--Base Year (Jan 03 ?????? Sept 04) Estimated Qty??????1,200; Item 0002--Option Year (Oct 04 ?????? Sept 05) Estimated Qty??????1,200. The requirement is for The Mississippi Readiness Sustainment Maintenance Site (MSRSMS), Camp Shelby, MS 39407. Pr ices quoted must include all applicable pick-up and delivery fees. Response time for picking up the drums shall be the next business day after receipt of the order. Drums will be delivered back to MSRSMS within 7 days after pick up. All drums must be i nspected in accordance with the manufacturer??????s specifications prior to them being turned to insure the drums are not out of tolerance. All drums that meet the manufacturer??????s specifications will be resurfaced within the tolerable specifications s tamped on each drum. The contractor will not be due compensation for drums that fall out of tolerance and shall be marked ??????Out of Tolerance.?????? All unserviceable drums will be returned to MSRSMS at no additional charge to the Government. Drums r esurfaced that are found faulty by the Government will be returned to the contractor for resurfacing at no additional cost to the Government. Additional applicable FAR Clauses: FAR 52.247-34 FOB Destination; FAR 52.216-18, Ordering (Oct 1995). (a) Any supplies and services to be furnished under this contract shall be ordered by issuance of delivery orders or task orders by t he individuals or activities designated in the Schedule. Such orders may be issued from time of contract award through September 30, 2004; 52.216-19, Order Limitations (Oct 1995) (a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than 15 brake drums, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract. (b) Maximum order. The Contractor is not obligated to honor -(1) Any order for a single item in excess of 50 brake drums; (2) Any order for a combination of items in excess of 50 brake drums. (3) A series of orders f rom the same ordering office within 7 days that together call for quantities exceeding the limitation in subparagraph (b)(1) or (2) of this section. Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within 7 days after issuance, with written notice stating the Contractor??????s intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source. 52.216-21,Requirements (Oct 1995). This is a requirements contract for the supplies and effective for the period stated. The quantities of supplies speci fied are estimates only. Except as this contract may otherwise provide, if the Government??????s requirements do not result in orders in the quantities described as estimated???????????? or maximum, that fact shall not constitute the basis for an equitable price adjustment. Any order issued during the effective period of this resultant contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor??????s and Government??????s rights and obligations with respect to that order to the same extent as if the order were completed during the contract??????s effective period; provided, that the Contractor shall not be required to make any deliveries under this contra ct after September 30, 2004. 52.217-9, Option to Extend the Term of the Contract (Mar 2000): (a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercises this option, the extended contract shall be considered t o include this option clause. (c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed beyond September 30, 2005. 52.232-19, Availability of Funds for the Next Fiscal Year (Apr 1984).
