- Description
- This is a notice of intent to award, on a sole source basis, for commercial items prepared in accordance with Simplified Acquisition Procedures and within the format identified in Subpart 12 of the Federal Acquisition Regulations. This announcement constitutes the only solicitation; the Department of Justice has a need for specific building utility related air conditioning services for office space, on an overtime basis [beyond the lease established normal hours of building operations], from Reit Management and Research, LLC [lessor] of the building located at 20 Massachusetts Avenue, NW, Washington, D.C. Because the Government only leases office space, logistically, we are not in a position to seek temporary outside support, i.e. portable chillers and fan coil units to condition the space; we are seeking inherently building related utility support through the building?s mechanical plant and making use of utilities provided under the terms of the lease. The terms of the requested service are detailed in the General Services Administration?s lease agreement section 6.3, OVERTIME USAGE (Variation), of the Solicitation for Offers for this leased space. Quotes are not being request and a written solicitation will not be issued. This notice incorporates the provisions and clauses in effect through Federal Acquisition Circular 16 [effective as of 10/31/03]. The proposed award shall consist of a base period and two (2) option years as follows: base period, December 8, 2003 - September 30, 2004, Option Period I - October 1, 2004 through September 30, 2005, and Option Period II - October 1, 2005 through September 30, 2006. The provision 52.212-1, Instructions to Offerors/Commercial Items Applies to this acquisition; as does provision 52.212-2, Evaluation/Commercial Items. OPTION TO EXTEND THE TERM OF THIS AWARD will be in keeping with FAR 52.216-2, Economic Price Adjustment should either option be exercised. (a) The Government may extend the term of this award by written notice to the contractor within 30 days; provided that the Government shall give the contractor a preliminary written notice of its intent to extend at least 60 days before the award expires. The preliminary notice does not commit the Government to an extension. (b) If the Government exercise the option(s), the extended order shall be considered to include this option provision. The total duration of this order, including the exercising of options shall not exceed 34 months. This notice is neither a request for quotation nor a solicitation of offers. No contract will be awarded on the basis of offers received in response to this notice. All inquiries and concerns must be addressed in writing to the Department of Justice/JMD/FASS, 1331 Pa.
