- The National Oceanic and Atmospheric Administration (NOAA), National Environmental Satellite, Data, and Information Services (NESDIS), issued a Request for Quotation under the authority of Federal Acquisition Regulation 8.402; GSA Special Ordering Procedures. The RFQ was issued to a number of GSA Schedule Holders. Information pertaining to this GSA procedures can be retrieved from the following web site: http://www.gsa.gov/Portal/content/offerings_content.jsp?contentOID=116992&contentType=1004&P=1&S=1 In addition to the procedures above, the responses to the Request for Quotation resulted in the incorporation of Open Market Items as defined at the following web site: http://www.gsa.gov/Portal/content/offerings_content.jsp?contentOID=117896&contentType=1004#openMarketItems that reads, ?Open Market Items-The Federal Acquisition Regulation (FAR) has been amended to incorporate policies that address the handling of open market items. Note: Open market items are also known as incidental items, noncontract items, non-Schedule items, and items not on a Federal Supply Schedule contract. In accordance with FAR 8.401(d), for administrative convenience, an ordering office contracting officer may add items not on the Federal Supply Schedule (Multiple Award Schedule) contract-i.e., open market items-to a Federal Supply Schedule blanket purchase agreement (BPA) or an individual task or delivery order only if- (1) All applicable acquisition regulations pertaining to the purchase of the items not on the Federal Supply Schedule contract have been followed (e.g., publicizing (Part 5), competition requirements (Part 6), acquisition of commercial items (Part 12), contracting methods (Parts 13, 14, and 15), and small business programs (Part 19)); (2) The ordering office contracting officer has determined the price for the items not on the Federal Supply Schedule contract is fair and reasonable; (3) The items are clearly labeled on the order as items not on the Federal Supply Schedule contract; and (4) All clauses applicable to items not on the Federal Supply Schedule contract are included in the order. This combined synopsis/solicitation is being issued in order to comply with items (1) and (2) above as they relate to a current existing requirement for which responses have already been received and evaluated. The open market items are listed in the attached document and interested parties shall provide pricing for those items and include the information requested below in their submission. THIS IS A COMBINED SYNOPSIS/SOLICITATION FOR COMMERCIAL ITEMS UNDER THE AUTHORITY OF THE FEDERAL ACQUISITION REGULATION (FAR) SUBPART 13.5 TEST PROGRAM FOR CERTAIN COMMERCIAL ITEMS, AND IS PREPARED IN ACCORDANCE WITH THE FORMAT IN FAR SUBPART 12.6 ? STREAMLINED PROCEDURES FOR EVALUATION AND SOLICITATION FOR COMMERCIAL ITEMS ? AS SUPPLEMENT WITH ADDITIONAL INFORMATION INCLUDED IN THIS NOTICE THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE BEING REQUESTED, AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. THIS SOLICTATION IS BEING ISSUED USING SIMPLIFIED ACQUISITION PROCEDURES. The solicitation number is NESDIS100 and is issued as a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2001-15. The associated North American Industrial Classification system (NAICS) code for this acquisition is 421510 with a small business size standard of 100 employees. This acquisition is unrestricted and all responsible parties may submit a quote. The quoter shall provide the attached items on a firm fixed price basis and shall submit on an all-or-none basis. The attached listing identifies the option years and optional items. The Government is not liable for optional items or option years unless they are unilaterally exercised through the issuance of a modification against this order. The period of performance shall be for a base year of twelve months starting from the contract award date and includes four option years of twelve months each. Interested parties must provide information that specifies their ability to deliver items as necessary to a number of locations including Darmstadt, Germany. The quoter shall be responsible for any delays in delivery that result in the Government incurring cost either by other Government Contractors or the Government itself. FOB Destination. FAR 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. This FAR reference can be retrieved from the Internet at the following url: www.arnet.gov/far. In accordance with FAR 52.212-1, offerors must show the solicitation number, the time specified in the solicitation for receipt of offers, the name, address, and telephone number of the offeror, a technical description of the items being offered in sufficient detail to evaluate compliance with the requirements, price, remit to address, if different than mailing address, and a complete copy of the representations and certifications at FAR 52.212-3. If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in this solicitation. FAR 52.212-2, Evaluation-Commercial Items applies to this acquisition. The Government may award a contract resulting from this solicitation to the responsible offeror whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The technical evaluation factors are technical approach and flexibility in meeting unknown schedule requirements. These evaluation factors other than price, when combined, are significantly more important than cost or price. The quotes received in response to this requirement will be evaluated against the GSA Schedule Holder?s quote for these open market items. If the GSA Schedule Holder?s prices are less than the prices offered herein, the Government will incorporate the GSA Schedule Holder?s open market items into the existing order that will be awarded under the GSA Special Ordering Procedures. If the GSA Schedule Holder?s prices are not the lowest price, the Government will evaluate the prices offered herein against the GSA Schedule Holder?s prices and make award based on a best value determination taking into consideration such factors as the logistical risk associated with a third party providing the items listed in the attachment and the potential cost associated with delay in delivery of these items. FAR 52.212-4, Contract Terms and Conditions ? Commercial Items, applies to this acquisition. FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders ? Commercial Items applies to this acquisition with the following numbered items from the clause marked as applicable: (1), (3), (7), (13) through (19), (24), and (30). Offerors shall submit (1) an original and two copies of the information specified by FAR 52.212-1 as restated above (including a technical description); (2) a copy of the offeror?s most recent published price list or pricing furnished for similar items to other customers; (3) a completed representation and certification in accordance with FAR 52.212-3; and (4) the completed price list as identified in the attached documents. In addition, you are required to complete and submit a vendor profile for your firm? the profile can be retrieved at http://www.ofa.noaa.gov/~amd/vendor_form.html Submissions shall be received by September 30, 2003 at 8:00 am local time. Any response received that does not provide all the requested information stated herein shall be considered nonresponsive.
