Description
The Proposed contract action is for supplies or services for which the Naval Medical Center San Diego intends to solicit with only one source, INO Therapeutics, Inc, 6 State Route 173, Clinton, NJ under the authority of Far 6.302. Interested contractors/persons may identify their interest and capability to respond the requirement or submit quotations. This notice of intent is not a request for competitive quotations. However, all quotes received within 6 days after date of publication of this synopsis will be considered by the Government. A determination by the Government not to compete with this proposed contract based upon responses to this notice solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. This is a combined synopsis/solicitation for commercial items, prepared in accordance with the format in FAR subpart 12.6 as supplemented with additional information included in this notice. This announcement constitutes only solicitation, quotations are being requested and a written solicitation will not be issued. The solicitation number, N00259-03-T-0053 is issued for reference purpose only. 0001: ON SITE INO THERAPY SERVICES, Intended uses: INO Therapy is a nitric oxide service provided to neonates for inhalation. Service provided under indefinite delivery type purchase order (IDTPO)-on-site service and corrective maintenance-contract on listed equipment including all parts, labor, transportation and unlimited corrective maintenance calls. 0001AA: On-site INO Therapy services to include the following components: Inomax(nitric oxide for inhalation), INOvent calibration gases in accordance with the Statement of work (SOW) for the period 01 May 2003 through 30 September 2003. The contractor shall provide Naval Medical Center San Diego, San Diego, CA with INOMAX (Nitric Oxide) for inhalation as part of a package called INOtherapy, which includes the following components: INOmax (Nitric Oxide for Inhalation), INOvent delivery system for Nitric Oxide therapy, INOcal Calibration Gases. The contractor shall pre-position the INOvent Delivery System in the Neonatal Intensive Care Unit, Building 1, and third floor without compensation. Once a physician prescribes INOtherapy, a warranted government ordering official will telephone contractor to initiate INOtherapy Service. The cylinders will already be in place with a monitoring chip in place, which monitors the start/stop date and time. All pertinent information will be noted on a NMCSD PR 1149, to include cylinder and lot number. The cylinder and lot number will be identifier in reconciling invoices. Contractor will provide all service and maintenance on the INO delivery system. NICU personnel will call contractor to inform of therapy completion date and time. The solicitation document and incorporated provisions and clauses are those in effect through FAC 2001-10. This acquisition incorporates the following FAR clauses: 52.212-1 INSTRUCTIONS TO OFFERS-COMMERICAL ITEMS (Oct95): FAR 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS-COMMERICAL ITEMS(Oct 95) must be completed and submitted along with the quote (please contact Patty Jo Hargis at (619) 532-8083 if a copy is needed; in accordance with FAR 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS-COMMERICAL ITEMS(Aug (96), the following clauses are incorporated by reference in paragraph (b): 52.222-26 EQUAL OPPORTUNITY (E.O. 11246); 52.222-35 AFFIRMATIVE ACTION FOR SPECIAL DISABLED AND VIETNAM ER VETERAN (28U.S.C.4212); 52.222-37 EMPLOYMENT REPORTS ON SPECIAL DISABLED VETERANS AND VETERANS OF THE VIETNAM ERA (38 U.S.C.4212) 52.222-36 AFFIRMATIVE ACTION FOR HANDICAPPED WORKERS(29 U.S.C. 793); 52.212-4 CONTRACT TERMS AND CONDITIONS COMMERICAL ITEMS(OST 95). DFARS 252.204-7004, REQUI RED CENTERAL CONTRACTOR REGISTRATION (MAR 1989); FAR 52.232-33 PAYMENT BY ELECTRONIC FUNDS TRANSFER-CENTERAL CONTRACTOR REGISTRATION(31 U.S.C. 3332); FAR 52.212-2, EVALUATION-COMMERICAL ITEMS(1/99). The following factors shall be used to evaluated offerors: 1) technical capabilities, contractor must be FDA approved 2) availability 3) price. Technical capabilities and availability have the same level of importance with the cost or price.
