- NA The U.S. Army, Fort Bragg, North Carolina is seeking to enter into Basic Ordering Agreements (BOAs) with responsible sources for the supply and delivery of natural gas. It is the Army's intent to issue BOAs to multiple Gas Providers/Marketers for the supp ly and delivery of natural gas. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) Subpart 12.6 as supplemented with additional information included in this notice. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION AVAILABLE. A WRITTEN SOLICITATION WILL NOT BE ISSUED. All offerors must reference Request for Proposal (RFP) number DABK07-03-R-0003. It is the contractor's responsibility to be familiar with all appl icable clauses and provisions. The North American Industry Classification system Code is 221210. The size standard is 500 employees. The terms of the BOA are contained herein. A.1. ORDERING PROCEDURES AND SERVICES TO BE PERFORMED. (a) The Government will request transport of natural gas under this agreement by distributing a Delivery Order (DO) containing this agreement number and the designated daily nominating quantity of natural gas for the specified months as required under the terms of this agree ment. This agreement shall apply only to natural gas delivered to North Carolina Natural Gas (NCNG) at Station 65 of the Transco Interstate Pipeline (TIP) for final delivery to the Fort Bragg Military Reservation. (b) The BOA Holder shall not furnish any natural gas pursuant to this agreement prior to the effective date of a request for such natural gas in the form of a signed and executed DO issued by the Directorate of Contracting, Acquisition Division, in accordance with FAR Clause 52.216-18, Ordering. A2. QUOTES AND QUANTITIES. (a) Each BOA Holder shall designate a primary and two alternate points of contact for pricing and receipt of orders on a monthly basis. A Government Agent, currently Honeywell, Inc., will be provided an estimated required am ount of natural gas for use by Fort Bragg for the following month. The Government Agent will telephonically obtain a price quote from the BOA Holders for the required quantity of natural gas. The price quote shall be for natural gas to be delivered at an average daily quantity (i.e. the same quantity each day) over the course of the month. The BOA Holder shall identify both the price per Decatherm (Dt) and the quantity available for the month. (b) If the BOA Holder cannot provide the full amount request ed, the BOA Holder may submit a Partial Price Quote with a unit price for the amount of natural gas available. (c) The BOA Holder shall provide the Government with a unit price for the estimated quantity of natural gas requested not later than five (5) bu siness days prior to the end of the month. The quoted price shall consist of all charges, to include commodity, interstate transportation and shrinkage, and all fees and taxes, for one month of firm natural gas to NCNG at Station 65 of the TIP for final d elivery to Fort Bragg. The BOA Holder will be provided a fair opportunity to be considered for each order, however, the Government will not necessarily order natural gas for transport every month. Requests for quotes are not orders and do not obligate th e Government for purchase of any amount until a DO is placed as described in Section A.3. A.3. ORDERS (Nominations). (a) The Government will place DOs for supply and delivery of natural gas by nominating quantities and prices (based on quotes received) to the BOA Holder on a DD Form 1155, Order for Supplies or Services, signed by a designated Contacting Officer. (b) The BOA Holder shall provide the Government confirmation that the Government's nomination has been received and that the natural gas has be en secured on behalf of the Government for Fort Bragg by signing the DO and by returning it to the Contracting Officer. This confirmation shall be no later tha n one (1) business day before the Local Distribution Company (LDC), currently NCNG, is required to nominate its natural gas volumes for the next month (this is currently and typically three (3) business days before the end of the month). (b) The BOA Holde r shall provide NCNG's Natural Gas Supply and Transportation Department, with a copy to the Contracting Officer, notice of the firm daily quantity of transport natural gas for a particular month and year, along with the quantity in Decatherms, that the BOA Holder will be providing to the Government for Fort Bragg. The BOA Holder shall also provide NCNG with the receipt point, Station 65 of the TIP, the Contract number, the physical source of the natural gas (i.e. field or well) and the producer, if known. This notice shall be no later than one (1) business day before the LDC is required to nominate its natural gas volumes for the next month and shall include the Fort Bragg DO number, the BOA number and the Agent Numbers. A.4. WARRANTY OF TITLE. The BOA Holder shall warrant title to all natural gas delivered by it under the BOA, that such natural gas is free from liens and adverse claims of any kind. A.5. STANDARDS. Natural gas delivered for transport under this agreement shall meet the American Nation al Standards Institute's (ANSI's) standards for volume and heating value. A.6. TRANSPORTATION AND IMBALANCES. (a) In the event the Government incurs any type of penalty and/or imbalance charges caused by the BOA Holder or the Transporter's failure to de liver the Monthly Nominated Quantity during the applicable monthly period, scheduled daily to the LDC's Citygate, the BOA Holder shall be responsible for all such charges. (b) The BOA Holder agrees to cooperate with the Government, the LDC, and any other Transporter(s) to correct imbalances through make-up natural gas volume adjustments during any applicable balancing period that may be provided for in the LDC's and/or the Transporter's (NCNG's) tariff. The NCNG Rate Schedule and T-10 contract addendum fo r Fort Bragg is available by contacting the points of contact identified on this solicitation. This document is provided for informational purposes only. The T-10 Transportation rate is the rate the Government will pay NCNG to transport the Natural Gas f rom Zone 5 to the Fort Bragg Military Reservation. The BOA holder?s price shall NOT include the transportation charges covered by the T-10 rate. A.7. COMPENSATION. (a) The Government will compensate the BOA Holder for the specified/delivered quantity at the rate quoted for the specified month. The BOA Holder shall submit invoices for the monthly supply of natural gas after the natural gas has been delivered. (b) The invoice shall include: the DO number and the dates of delivery, the quantity of natur al gas delivered, the unit price for the natural gas, the total cost for the natural gas and any applicable prompt payment discounts. (c) The address for submission of invoices will be provided on each DO. A.8. TERMINATION OF AGREEMENT. Termination by either party shall not be the basis for any special charge of claim by the Contractor. Contractor shall be provided 30 days to stop work in any Termination notice. A.9. TERM OF AGREEMENT. This agreement shall remain in effect for five full years from the date of the Contracting Officer's signature unless sooner terminated by either party under the terms and conditions set forth in the BOA. The BOA shall contain two one-year option periods. A.10. DEFINITIONS. Explanation of some terms as they apply to this BOA is available by contacting the points of contact identified in this solicitation. A.11. HISTORICAL DATA. Historical data on past usage of natural gas by Fort Bragg is available by contacting the points of contact identified in this solicitat ion. A.12. PROVISIONS AND CLAUSES INCORPORATED BY REFERENCE. Price competition will be accomplished on a monthly basis between BOA Hold ers. The contractor shall provide recent and relevant past performance information on contracts that the contractor has performed. Recent means within the past 5 years; relevant means similar in size, scope, and complexity to this requirement. Those ref erences will be contacted relative to relevant past performance. The resulting information will be used to determine whether or not the contractor should become a BOA Holder and as information supporting a determination of responsibility. The Government also reserves the right to contact other sources relative to the contractor's experience and past performance.
