Description
The Contractor shall provide Occupational Health physician services in support of Naval Hospital Charleston, South Carolina. Contractor personnel shall comply with the standards of the Joint Commission with regard to applicable provisions of law and the rules and regulations pertaining to licensure and regulation of healthcare personnel.Routine workload is scheduled by the MTF. Primary workload is a result of appointments scheduled through the Occupational Health Department. Secondary workload is the result of requests submitted to the Occupational Health Department from MTF staff or contracted physicians. The Contractor shall not introduce new medical procedures or services without prior recommendation to, and final approval of, the Commanding Officer and the Contracting Officer.Prior to assumption of any tour of duty, the contract physician reporting for duty may be briefed by the Department Head or his/her designated representative concerning anything relevant to the Contractor's assumption and discharge of responsibilities under the terms of this contract. Contract physicians shall advise the Department Head of any problems, encountered or anticipated, relevant to meeting the needs of patients served by the Contractor, including any personnel problems. All contract health care practitioners shall participate in the MTF's medical Performance Improvement Program for ongoing monitoring and evaluation of the quality and appropriateness of care. All physicians providing services under this contract shall be subject to the professional staff appointment, clinical privileging and adverse credentials actions/fair hearing/appeals processes of the clinic as specified in BUMEDINST 6320.66C (Credentials Review and Privileging Program), BUMEDINST 6320.67A (Adverse Privileging Actions, Peer Review Panel Procedures and Healthcare Practitioner Reporting) and in the MTF rules, regulations and medical staff bylaws. All contract physicians are required to apply for membership on the appropriate professional staff and for clinical privileges at the MTF. The Contractor shall adhere to the requirements of any changes made to the aforementioned documents during the term of the contract.Contract physicians are required to apply for membership on the appropriate professional staff and for clinical privileges.The Contractor is responsible for performing credentials verification on all healthcare practitioners prior to submission of the credentials to the clinic. The Contractor shall submit complete credentialing packages to the Professional Affairs Coordinator, via the COR, not less than 30 calendar days prior to performance of services by the contract physicians. The MTF will respond to each credentialing requests within 30 days of receipt of a complete credentials package. The failure of the Contractor to submit a complete credentials package will invalidate the requirement for the Navy to respond within 30 days. The failure of the Contractor to submit complete credentials 30 days prior to contract start will not constitute an excusable delay or lapse in contract performance.The Contractor shall verify the following information including, but not limited to, those qualifications as outlined in Section C.13, all state licenses/certifications held within the last ten years; and Education Council for Foreign Medical Graduates certificates. For purposes of meeting the 30?day submission requirement of paragraph 5.2.1.3, verification shall consist of either: (1) a response on original letterhead paper from the primary issuing agency or (2) a telephone verification from the primary issuing agency plus a copy of the outgoing letter to the primary issuing agency requesting written verification. The telephone verification shall include documentation of the person who requested the verification and their position; the agency, person and position of the verifying entity; and the date of verification. The Contractor shall, immediately upon receipt, provide issuing agency's original letterhead verification response to the MTF's Professional Affairs Coordinator.The MTF will retain the credentials documentation submitted for each healthcare practitioner within an official credentials file in accordance with BUMED and MTF instructions. The Contractor shall ensure that all documentation necessary to keep each individual healthcare practitioner's file current is submitted to the MTF's Professional Affairs Coordinator for inclusion in each file. The Contractor shall maintain a file of complete credentials packages for each employee during the life of this contract. It is emphasized that the file and the documents therein shall be kept current and shall be made available for Government inspection upon request. Contract physicians shall not perform any healthcare services until professional staff memberships and clinical privileges have been granted in writing by the Commanding Officer. The Commanding Officer is the sole authority for granting and revoking clinical privileges. The MTF reserves the right to perform reverification of credentials information. The Commanding Officer may withhold clinical privileges until it is determined that credentials information has been satisfactorily verified. Exceptions to the credentialing review and clinical privileges process as defined by BUMEDINST 6320.66C and BUMEDINST 6320.67A will not be considered. The Contractor's failure to submit successful applicants will not constitute an excusable delay or lapse in contract performance. Any contract healthcare practitioner who fails to maintain medical staff appointment or clinical privileges will not be permitted to perform services under the contract and shall be promptly replaced by the Contractor. Any contract healthcare practitioner under suspension due to an investigation at any facility or licensing agency shall not be permitted to provide service under this contract until full privileges are restored and the Credentials Committee approves the action to restore privileges. The Contractor shall notify the COR within 24 hours of any suspension of a contract healthcare practitioner. The Contractor shall inform the COR of any terminations of employment within 24 hours of the action. Permanent revocation of clinical privileges and permanent adverse administrative actions due to professional misconduct against licensed or certified practitioners shall be reported to the appropriate professional licensure clearinghouse and/or to the licensing authorities of the state in which the services are performed in compliance with SECNAVINST 6401.2. In addition, contract providers are advised that the Department of Defense participates in the national reporting system established under Part B of the Health Care Quality Improvement Act of 1986, Public Law 99?660. Reports, naming individual practitioners, shall be submitted to the National Data Bank in accordance with this Act. Contract physicians may be granted clinical privileges at and be members of the medical staff of the MTF only when they are specifically assigned to work at the MTF during their employment by the Contractor. If the physician's employment with the Contractor ends for any reason, or if the physician is no longer assigned to work at the MTF, all clinical privileges and medical staff appointment shall be terminated without recourse to the fair hearing and appeals procedures specified by the medical staff bylaws and BUMEDINST 6320.67A. The Contractor shall employ personnel who are medically fit. The Contractor shall require evidence of sound physical and mental health status from each Contractor employee prior to performance by each employee. Such evidence shall be submitted to the COR with, and at the same time as, the documentation required by paragraphs C.5.2.1, C.5.2.2, C.5.2.3, and their subparagraphs. No physicals, medical tests, or procedures required to comply with this paragraph may be performed at the MTF except for eligible beneficiaries. Expenses for all required tests and procedures shall be borne by the Contractor at no additional cost to the Government.The Contractor shall provide evidence of immunity to measles, mumps and rubella (MMR) for Contractor employees who have patient contact. Such evidence can be through proof of serological testing which shows seropositivity to MMR or through proof of vaccination (persons born before 1957 must have received one dose of MMR vaccine and persons born in 1957 or later must have received two doses of MMR vaccine). Evidence, in the form of a signed physician record/statement or results from an accredited laboratory, shall be provided to the COR prior to the provision of services by the employee. Both staff and patients shall be protected from possible transmission of hepatitis B to the maximum extent possible. Therefore, the Contractor shall accomplish immunization or provision of evidence of seropositivity for hepatitis B at the earliest possible time following commencement of service by each Contractor employee who has patient contact. The Contractor employees abide by one of the following guidelines for hepatitis B vaccine. Prior to employee start date, the Contractor shall:Provide evidence of the employee receiving at least three doses of recombinant hepatitis B vaccine currently licensed in the United States; or,Provide documentation of the employee receiving an initial dose of the hepatitis B vaccine. The vaccine series shall be completed within 6 months of the employee start date. Evidence of completion of the hepatitis B vaccine series by an employee shall be provided to the COR; or,Provide evidence of immunologically effective anti-HB levels for employees in lieu of proof of recombinant hepatitis B vaccines. Assays must be performed in a laboratory accredited by the College of American Pathologists (CAP; or, Provide documentation of the employee's waiver which declines the hepatitis B vaccine as set forth in OSHA guideline 29 CFR Part 1910.1030. All evidence shall be in the form of a signed physician record/statement or results from an accredited laboratory. Each Contractor employee shall be screened for tuberculosis and the Contractor shall provide evidence of such screening, in the form of a signed physician record/statement or results from an accredited laboratory, to the COR prior to the provision of services by the employee. PPD tests shall be repeated not less than every year or, for employees who are known PPD reactors, evaluation and counseling shall be conducted in accordance with current CDC guidelines. Documentation of testing or evaluation and counseling shall be provided to the COR annually. The Contractor shall provide evidence, in the form of a signed physician record/statement or results from an accredited laboratory, of immunity to varicella for Contractor employees who have patient contact. Such evidence can be through proof of positive varicella antibody titer or by a written statement of the employee's history of chicken pox infection. Place of Contract PerformanceAddress/City/State? The Contractor shall be responsible for the management of employees who have been identified as HIV-positive. Management of HIV-positive Contractor employees shall be consistent with current CDC guidelines and Section 503 of the Rehabilitation Act (29 U.S.C. Section 793) and its implementing regulations (41 CFR Part 60?741). Contract healthcare practitioners must apply for professional staff appointments in accordance with the provisions of BUMEDINST 6320.66C, Section 2, paragraph 3 (e), which states that health status consideration may be accomplished through a variety of means. As a means of establishing the health status of each individual, the Contractor shall submit one of the following for each individual: A statement from the applicant's physician or a report of a physical examination conducted within 60 days prior to commencement of employment indicating that the applicant is free from mental or physical impairments. The applicant's statements regarding health status on the application for privileges and the Personal and Professional Information Statement for Privileged Providers including updates. Performance Appraisal Reports from previous medical treatment facilities. Responses to requests for credentials and privileging information from institutions or agencies external to the current medical treatment facility. Healthcare practitioners shall immediately inform the MTF Professional Affairs Coordinator via the COR of any change in the status of professional qualification, including a change in health status, which could impair the ability to provide safe, competent, authorized healthcare services. All contract employees shall undergo a total of at least 4 hours of Command and Department orientation within the MTF. Orientation shall take place within 10 days following commencement of services. Orientation is not intended for clinical training and will focus on familiarization with administrative procedures. Specifically, this orientation is intended to familiarize contract practitioners with MTF and Occupational Health Department work policies, requirements, and procedures, including medical forms and reports. In addition to the orientation period, the Contractor will be allowed access to the facilities, subject to approval by the COR, to coordinate and finalize quality control plans and to familiarize personnel with facilities, equipment, supplies, work schedules, and other administrative procedures. Such access shall not interfere with patient care activities or production efforts of current personnel. Provide a full range of Occupational Health physician services in accordance with privileges granted by the Commanding Officer. Supervise, perform, or assist in the instruction of, other health care professionals seeing patients within the scope of their clinical privileges or responsibilities. Promote preventive and health maintenance care, including annual physicals, positive health behaviors, and self-care skills through education and counseling.Request consultation or referral with appropriate physicians, clinics, or other health resources as indicated. Order diagnostic tests as applicable. Prescribe and dispense medications as delineated by the Pharmacy and Therapeutics Committee. Maintain a level of productivity comparable with that of other individuals performing similar services. Participate in peer review and performance improvement activities.Participate in the Command's Bloodborne Pathogen Program, including orientation, annual training, and exposure procedures. All records produced in the performance of this contract and all evaluations of patients are the property of, and subject to the exclusive control of, the Government. The Contractor may retain a copy of all such records or evaluations, but may not provide further copies or disclose the information from such records or evaluations to third parties. All requests from other treatment facilities or other individuals for patient records shall handled in accordance with procedures specified by applicable Naval Hospital instructions. If a subpoena or court order is received for the production of a medical record, the Contractor shall refer the subpoena or court order to the COR for action. Contractor staff shall provide detailed written explanations and recommendations, as requested, to members of the Naval Hospital medical staff regarding QAI/RM issues within 5 working days. Contractor staff shall participate, at the Contractor's expense, in continuing medical education programs and shall annually complete the continuing education credits sufficient to maintain the licenses/certificates of individual employees. The Contractor shall maintain the documentation necessary to validate work performed. Contractor employees shall actively participate in implementation of the MTF Family Advocacy Program in accordance with applicable MTF instructions. Participation shall include, but not limited to, appropriate medical examination, documentation and reporting.Prior to Contractor employees providing services under this contract, the Contracting Officer's Representative (COR) will ensure compliance of each member of the Contractor's staff with the qualifications given in Section C-13. Documentation shall be submitted to the COR a minimum of 30 calendar days prior to performance of services. The Contractor staff shall assist the Navy in its review of Contractor performance in relation to evaluation of utilization management. The Contractor shall provide services from 0730 to 1600 hours (7:30am to 4:00pm), Tuesdays, excluding the ten (10) Federal holidays. The healthcare worker shall receive an uncompensated 30-minute mealbreak.The Contractor is not required to provide services on the ten (10) Federal holidays, which include New Year's Day, Martin Luther King's birthday, George Washington's birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran's Day, Thanksgiving Day, and Christmas Day. The Contractor shall not allow contract employees whose judgment is impaired by alcohol, drugs or other mood?altering substances to perform under this contract. The Contractor shall not employ persons convicted of violations of criminal statutes, felonies, or misdemeanors involving crimes against persons or moral turpitude. At his own expense, the Contractor shall conduct such background checks of prospective employees as may be necessary to ensure compliance with this paragraph. The Contractor shall not employ aliens in performance of the contract in violation of the Immigration Laws of the United States. Confidentiality Of Information. Unless otherwise specified, all financial, statistical, personnel and/or technical data which is made available, in any way, to the Contractor during the performance of this contract are proprietary in nature and shall not be used for purposes other than performance of work under the conditions of this contract. The Contractor shall not release any data obtained through the performance of this contract without prior and specific written consent from the COR. Any presentation of any statistical or analytical materials, or any reports based on information obtained from the studies covered by this contract, will be subject to review and approval by the Commanding Officer via the Contracting Officer's Representative before publication or dissemination. The Contractor shall maintain and enforce standards of conduct for contractor employees and shall take appropriate corrective action. A report of the corrective action taken shall be provided to the COR and Commanding Officer for concurrence. The Contractor shall not hire any employee for performance under this contract whose employment would result in a conflict with Government or Navy Standards of Conduct (SECNAVINST 5370.2 (latest revision)).The Contractor or contract employees shall not bill personnel entitled to care at this hospital for services rendered. The Contractor and contract employees are not prohibited from outside employment by the conditions of this contract, if there is no conflict with the performance of services under this contract. Contractor employees shall present a neat, professional appearance. Communication. Contractor staff must be able to read, write and speak the English language fluently to ensure the effective administration of this contract. The Contractor shall be responsible for compliance with any certification or requirement arising from Federal and State health regulations in the performance of this contract. The Contractor shall be responsible for payment of all wages and salaries, taxes, penalties, fees, fringe benefits, professional liability insurance premiums, contributions to insurance and pension or other deferred compensation plans including, but not limited to, Workers' Compensation and Social Security obligations, licensing fees, etc. The Contractor shall also be responsible for the filing of all requisite documents, forms and returns pertinent to all of the foregoing. The Contractor shall indemnify from and hold the Government harmless against any and all claims by contractor employees for the foregoing payment compensation or documentation. The Contractor agrees to pay all applicable federal, state and local income taxes, including any and all other governmental taxes, fees or expenses levied against it. An outline of the qualifications for contractor staff is given below. In addition to the qualifications given here, Contractor employees shall have the ability to perform the applicable duties consistent with their license, certification, registry, education, or experience, given in Section C-5 of this work statement. All Contractor employees shall comply with any applicable state regulations regarding their license, certification or registry. The Contractor shall provide to the COR an original signed statement from each Contractor staff member certifying that the Contractor staff member now meets and will continue in the future to meet the applicable personnel qualifications set forth in Section C-13, that he/she will comply with the Naval Hospital bylaws, rules and regulations. The Contractor shall ensure that employees providing services under this contract are able to read, write, and speak English fluently in order to effectively communicate with all personnel eligible for medical care and the staff of the MTF. Contract employees shall have the ability to enunciate with sufficient clarity to be readily understood by patients and staff. The Contractor shall be eligible for U.S. employment. No alien shall be allowed to perform under this contract in violation of the Immigration Laws of the United States. The Contractor shall be physically capable of standing and/or sitting for extended periods of time and capable of normal ambulation. The Occupational Health physicians shall meet and maintain the following minimum qualifications: Graduation from a medical school approved by the Liaison Committee on Medical Education of the American Medical Association or the American Osteopathic Association or certification by the Educational Council for Foreign Medical Graduates (ECFMG). Successful completion of a residency program in either Occupational Medicine or Preventive Medicine which has been approved by the Accreditation Council for Graduate Medical Education or the Committee on Postdoctoral Training of the American Osteopathic Association or those Canadian training programs approved by the Royal College of Physicians and Surgeons of Canada or other appropriate Canadian medical authority. A current, valid, unrestricted license in one of the fifty States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, or the U.S. Virgin Islands. Current certification in Basic Life Support (BLS) and Advanced Cardiac Life Support (ACLS).
