Description
Supply and deliver an estimated 310 tons of anionic high float polymer modified emulsion (HFE-90-IS) and rent a distributor truck with operator for approximately 40 hours. Item 0001 is the supply of an estimated 310 tons of anionic high float polymer modified emulsion (HFE-90-IS). Item 0002 is the delivery, FOB destination, of an estimated 310 tons of anionic high float polymer modified emulsion (HFE-90-IS). To reach the point of delivery, begin in Silver Lake, Oregon, on Oregon State Highway 31. Travel east approximately 1 mile and turn south onto Forest Road 27 (also known as Lake County Road 4-11) on the Fremont National Forest. Travel approximately 16.5 miles on this road to the site. Delivery shall take place on approximately August 12, 2002, as coordinated with Roland Glade, Forest Road Maintenance Manager. Item 0003 is the rental of a distributor truck with operator for an estimated 40 hours at the same site as specified in item 0002. The estimated 40 hours will begin upon delivery of the oil. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation number, R602-02-0073, is issued as a request for quotation (RFQ) with evaluation criteria accomplished under the Simplified Acquisition Procedures of FAR Part 13. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2001-07. This solicitation is not set-aside for small business. The NAICS code is 422720 and the small business size standard is 100 employees. The provision at 52.212-1, Instructions to Offerors, Commercial Items, is applicable, with the following changes or additions. Paragraph (i) (1) (ii) is changed to disallow the availability of a written copy of the specifications, standards, and commercial item descriptions cited in this solicitation. Quoters may submit facsimile quotes as responses to this solicitation. These responses must arrive at the place and by the time specified in the solicitation. The Government reserves the right to make award solely on the facsimile quote. However, if requested to do so by the Contracting Officer, the apparently successful quoter agrees to promptly submit the original signed quote. The telephone number of the receiving facsimile equipment is 541-947-6242. If the quoter chooses to transmit a facsimile quote, the Government will not be responsible for any failure attributable to the transmission or receipt of the facsimile quote including, but not limited to, (a) receipt of garbled or incomplete quote, (b) availability or condition of the receiving facsimile equipment, (c) Incompatibility between the sending and receiving equipment, (d) Delay in transmission or receipt of quote, (e) Failure of the quoter to properly identify the quote, (f) Illegibility of quote, or (g) Security of quote data. The Government will issue an order as a result of this RFQ to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, cost or price, experience, and past performance considered. Quoters shall provide a list of all contracts completed within the last 3 years, including the name and phone number of the contract administrator. The Government is not obligated to request additional information and in the absence of appropriate information; the Government may rely on personal knowledge of the firm. Quoters with no record of past performance will receive a neutral rating for past performance. Quoters with no experience in the type of work solicited may list other types of projects which exemplify their past performance. The Government may issue orders to other than the lowest quote, waive minor informalities or irregularities in quotes received, or elect to not award at all. If necessary, the Government may conduct discussions with any or all quoters. Quoters shall include a completed copy of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Items, with their quotes. The clause at 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition. The following clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition. 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items (May 2002) (a) The Contractor shall comply with the following FAR clauses, which are incorporated in this contract by reference, to implement provisions of law or executive orders applicable to acquisitions of commercial items: (1) 52.222-3, Convict Labor (E.O. 11755). (c) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (c) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records-Negotiation. (1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract. (2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved. (3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
