Description
This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 6. The National Oceanic and Atmospheric Administration (NOAA) intends to solicit and negotiate on a sole source basis with the American Bureau of Shipping (ABS) for the acquisition of services to provide surveys, plan reviews, certifications, statements of fact and reports. ABS will perform ship surveys, plan reviews and inspection audits regarding the application of international convention regulations, statutory requirements, ABS Class Rules and maritime industry standards to vessels of the NOAA Fleet and other vessels which may embark NOAA Personnel. Surveys asx to the status of compliance and non-compliance with IMO Conventions including the following and others: The SOLAS Convention, including: Cargo Ship Safety Construction Surveys, Cargo Ship Safety Equipment Surveys, Cargo Ship Safety Radio Surveys, International Safety Management Code. The Load Line Convention, and associated certifications. The MARPOL Convention, including: International Oil Pollution Prevention. The STCW Convention and associated certifications. The International Tonnage Convention. Surveys and plan reviews to apply and maintain statutory requirements and ABS class status during ship maintenance, alteration, conversion and construction. Surveys, inspections, audits and plan reviews required to determine the compliance status of marine systems and equipment with respect to marine industry standards not otherwise addressed by class rules and statutory regulations. The statutory authority for less than full and open competition is 41 USC 253 (c)(1), Only One Responsible Source. The American Bureau of Shipping is the only known source with the requisite expertise to provide the required services. The period of performance will be 4/26/02 through 4/25/03 with 3 one year options. Estimated 250 hours per year. Interested persons must identify their interest and capability to respond to the requirement within 15 days of this notice. This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this proposed contract based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Evidence must be provided of the ability to provide the required services. Any party interested in receiving a copy of the solicitation shall provide written notice to the Contracting Office. All responses from responsible sources will be considered. See Note 22. The provision at 52.212-1, Instructions to Offerors-Commercial, applies to this acquisition. Offerors are to include a completed copy of the provision at 52.212-3 Offeror Representations and Certifications-Commercial Items, with its offer. The clause at 52.212-4, Contract Terms and Conditions-Commercial Items, applies to this acquisition and any attached addenda. The clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders-Commercial Items, applies to this acquisition.
