Description

Defense Commissary Agency (DECA) is in need of purchasing the software support of Pro/Space Plus Software 5 licenses ICP/IVS Volume5 for one year with two option years. This sole-source synopsis for commercial items is prepared in accordance with the format in FAR subpart 12.6, as supplemented. No solicitation is expected to be issued, and no proposal is expected to be requested. The Standard Industrial Classification (SIC) code is 7372:Prepackaged Software, small business size standard: $18 million (NAICS Code 511210). This serves as notice of intent to award a contract on a sole-source basis in accordance with Federal Acquisition Regulation 6.302-1, to JA Software, Inc. This is necessary because it is the only known responsible and responsible source that can satisfy the Government?s particular software requirement to support the Defense Commissary Agency?s Windows-based INTACTIX space management system. The Defense Commissary Agency has a requirement to license five copies of Pro/Space Plus Software from JDA Software, Inc., with annual software maintenance. This unique requirement can only be met by contracting for the required computer software from the same source on an ?other than full and open competitive? basis. For information regarding this sole-source contracting action, please contact Mr. Bob Mitchell, Contracting Specialist, Headquarter Defense Logistics Agency, DLA Support Services, Corporate Contracting Office, at telephone number (703) 767-1184 by 5:00 PM local time, 27 March 2002. . This is a sole source combined synopsis/solicitation for commercial items prepared in accordance with the format in the Federal Acquisition Regulation (FAR), Subpart 12.6 an FAR 5.203 (a)(2), as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposal is being requested and a written solicitation will not be issued. The standard industrial classification code is 7373, Prepackaged Software, $18 million. This also serves a notice of intent to negotiate on a sole source basis (Ref. FAR 6.302-1, Only one Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements), with JDA Software, Group, of 14400 North 87th Street, Scottsdale, AZ 85260 on an other than full and open competitive basis because they are the only known source for the software. The contractor shall extend to the Government full coverage of any standard commercial warranty normally offered in a similar commercial sale. Acceptance of the warranty does not waive the Government?s rights with regards to the other terms and conditions of this contract. In the event of a conflict, the terms of the contract shall take precedence over the warranty. The warranty shall begin upon final acceptance of the applicable deliverables listed in the schedule. This procurement will be F.O.B. Destination and delivered to: Defense Commissary Agency, 1300 E Avenue, Fort Lee, VA 23801, Attn: POC: Ms Mary Gerum. Inspection and final acceptance shall occur upon the competition during installation. FAR 52.212-2 INSTRUCTION TO OFFERORS?COMMERCIAL ITEMS (MAR 2000) is incorporated by reference and applies to this acquisition. FAR 52.212-4 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS?COMMERCIAL ITEMS (FEB 2000), is hereby incorporated by reference. The following clauses apply to this solicitation and any resultant contract, FAR 52.203-6,Alternate I, FAR 52.212-4, FAR 52.216-24, FAR 52.222-35, 52.222-37, FAR 52.232-33, FAR 52.222-26, DFARS 252.225-7001, DFAR 252.225-7002, and DFARS 252.247-7023. One original signed and dated firm fixed price proposal for each requirement must be submitted to Mr. Bob Mitchell, Contract Specialist, DLA, by 3:30 P.M. EST March 27, 2002.
