Description
Notice of Intent: Pursuant to FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements?, the Ohio Field Office intends to enter into negotiations on a sole source basis with West Valley Nuclear Services Company for the continued management and operation of the West Valley Demonstration Project. The period of performance for the planned contract extension is 27 months, beginning October 1, 2002 and continuing through December 31, 2004. The scope of the planned extension includes completion of the construction of a remote handled waste facility, decontamination of the most highly contaminated portions of the facility, safe lay-up of the high level radioactive waste storage tank farm and vitrification facilities, and development of a comprehensive project turnover package, including final documentation packages of high level waste canisters to permanent repository criteria. Furthermore, at the end of the 27-month performance period, the site will be configured to address one of the following three options: proceed with waste management activities (e.g., waste characterization and shipping), and decommissioning to Nuclear Regulatory Commission criteria specific to the West Valley site; waste management activities only; or safe ?lay-up? and minimal maintenance. It is anticipated that the contemplated extension will serve to enhance the opportunity for competition for the follow-on contract for the period beyond December 31, 2004. By leveraging WVNS? unique capabilities and completing the highest risk elements of the project, DOE will be strongly positioned with several options for the successor contract. As a result, it will be possible to develop a work scope and solicitation package that will promote and provide for full and open competition to the widest extent. West Valley Nuclear Services Company, as operator of the West Valley Demonstration Project since its inception in 1981, possesses unique qualifications in the areas of vitrification facility design, construction, and operation, design and in-process construction of the remote handled waste facility essential to its decontamination, detailed knowledge of the extent and nature of site contamination, activities necessary to conduct expeditious facility decontamination, and necessary regulatory and community interfaces. These qualifications are essential to the Department?s ability to fulfill its obligations under the project?s authorizing legislation, The West Valley Demonstration Project Act of 1980 (P.L. 96-368). Additionally, pending the completion of the site Environmental Impact Statement and issuance of a Record of Decision, the conduct of a competitive acquisition for a 27 month period of performance is considered to be disruptive to such an extent as to jeopardize the project schedule and would result in significantly increased cost to the Department. As a result it has been determined that only one responsible source is available and no other services will satisfy the needs of the Department. THIS IS NOT A SOLICITATION FOR PROPOSALS OR AN INVITATION FOR BIDS. THE GOVERNMENT DOES NOT ANTICIPATE RECEIVING RESPONSES TO THIS NOTICE OF A NON-COMPETITIVE ACTION. IF PARTIES CHOOSE TO RESPOND, ANY COST ASSOCIATED WITH THE PREPARATION AND SUBMISSION OF DATA OR ANY OTHER COSTS INCURRED IN RESPONSE TO THIS ANNOUNCEMENT ARE THE SOLE RESPONSIBILITY OF THE RESPONDENT AND WILL NOT BE REIMBURSED BY THE GOVERNMENT.
